-18-Mostalah Hadeeth Class by Abu Abdullah




-it is a new field
-this field is the field of interpretation

So we have the hadith
-we know whether it is authentic or not
-and then we want to interpret it

Sometimes when you having a discussion with a deviant
-you respect/accept him when he gives hujjah
-and he will say we all know that so and so...........
-if you ask him who is all?
-and he just says everybody
-where did you get the so and so
-we don’t know

So we need to know how to take this on
-First if he gives a hadith, he will give you a reference
-and say imam Bukhari in his sahih said so and so
-or it is in Muslim or in the sunans

If he is a respectable person he will do this
-if not he will not give a reference, and then you have to be careful
-and if he does not give a reference then he did not say anything

There is no hadith without a reference
-and there is nothing like common sense in this
-or it is a well-known issue etc.

1. Every hadith should have a reference
2. And we have to evaluate the reference

A man will say to you, you have to obey the rulers
-and if you ask him who said so?
-he also will say the flesh of the scholar is poison
-meaning if you slander him
-and for them if you speak the truth that is slander
-so he will tell you don’t you know the hadith the blood of the scholar is poison

This is not a hadith
-it is a saying not even by a sahabah
-it was by an Ash’ari
-so you have to know who said it

Al-Hâfidh Ibn ’Asâkir (d.571H) said in Tabyînu Kadhabul-Muftarî (p.29):

“Know, O my brother - may Allâh awaken you and I to His pleasure and make us of those who have deep fear and piety in Him as we should have - that the flesh of the Scholars is poisonous. It is well known that Allâh will expose those who seek to revile and belittle them and that whosoever lets loose his tongue by insulting and belittling the Scholars, then Allâh will cause his heart to die before he actually dies.”

Then he will tell you how can you talk about the ulama?
-you will say, am just saying fear Allah, what he is doing is not right
-so you ask him who said it?
-he will say it was ibn Baaz
-and again say the flesh of a scholar is poison

But his shaikh was only a person who worked for the government
-he worked and ate from a man who wore the cross
-so he is not to be listened to

So initially we need to have a reference
-which will be the hadith
-mostly they will say Albaani said it is sahih

So tell him Albaani lived in the last century
-and died in the 1990s
-so if you tell me Albaani said so I will ask you, did Islam start with Albaani?
-is he a new prophet or just a scholar
-so Albaani is not enough, even if he is infallible, Islam did not start with him

The deviant will now start to tremble
-and know that you have knowledge because most of the hadith they quote,
-they rely on your fear of not been exposed to the hadith
-so they will say Albaani said so, Uthaymeen said so
-so we have to stop and question

I was not told in the Qur'an and Sunnah that I take Islam from these 3 scholars
-and scholarship is not an absolute value, it is not born with the person
-proof should be given

We had prophet Nuh whose son was a kaafir
-so not because you are from a certain family you are a scholar
-there are some people with high certificates and they are not scholars
-and those Jahmiyya are the first to admit this fact

If you ask them about the Shaikh of Azhar they will tell you he is deviant
-but he has PhD

So how do we know who is a scholar?
-is it by the number of followers he has?
-many people are following Shaikh of Azhar than Bin Baaz
-so it is not a matter of certificate, followers etc.
-he is called Tantaawi, a deviant by all measures

So our reference is Qur'an and Sunnah
-and be very careful of those Saudi Salafis
-because they like using the names of ‘THE 3’
-and you are recommended not to insult those people
-tell them I accept they are scholars
-but do you have anything from Qur'an and Sunnah
-now we will start our discussion

I will give you the names of books and I will like you to memorize them
-we have 9 books and one of them is,
-Sahih al-Bukhari - this is a book of hadith
-and most likely you can be fooled into applying a hadith in reality
-without consideration, so be careful

This book was written by Imam Bukhari
-and from our understanding
-if the rasul (SAW) said whoever obeys my Ameer obeys me
-so this deviant comes and says, you have to obey this Ameer
-why? Because the prophet said so.

He is fooling you now
-because the ruler of Libya is a ruler and he is telling you to follow him
-but the Saudi government said Gaddafi is kaafir
-so why is the Saudi government accepted and not Gaddafi?
-Hosni Mubarak, Ben Ali and Abdullah Saleh
-why does the hadith apply to only one person?
-because you want it to apply to that person alone

If you go to Fath al Baari fi Sharh sahih al Bukhari
-written by Ibn Hajar, a Shafi’i
-if you open it you will understand it was talking to people away from Medina
-people from Yemen for example

The rasul (SAW) assigned an Ameer
-Abu Ubaidah at some stage and Ali at another stage
-so the rasul said if you obey these my Umaraa, then you are obeying me
-he is telling them to obey Ali because he told them the instructions
-so the hadith does not apply to all rulers or whoever you want it to apply to

Why is Gaddafi different?
-he was still the same kaafir from the beginning

In 1990 Saddam Hussein went to pray in Mecca
-Saudi newspaper said salahuddin came here and prayed
-and ibn Baaz was praying in the same place with Saddam
-so how can you pray behind a kaafir?

6 months later when Saddam invaded Kuwait, he became a kaafir
-what has changed with Saddam? he was still a ba'thi, a kaafir
-unless invasion of Kuwait makes someone a kaafir
-so they make Islam suit their purposes

One of my friends said that if America should tell Saudi to accept homosexuality
-the Saudi scholars will make marriage haram
-and will look for hadith to suit their rulers and make marriage haram
-they make Islam go their way, but this is haram
-playing with the religion is the worst thing

So we go to basics
-there is another book by ibn Rajab called Fath ul Bari, who is Hanbali
-the difference between the two is that,
-ibn Rajab is stronger when it comes to Asma wa Sifaat
-because the Asha’ira have problems with this
-so I recommend you keep a copy of both books
-even though ibn Hajar’s book is stronger as a whole,
-if it is a matter of Asma wa Sifaat refer to ibn Rajab’s book

Or if you need to have both, just read ibn Hajar only
-but if it is about Asha’ira stuff, stay away from ibn Hajar
-because there are sometimes that he did ta’weel
-this is not to say he is a deviant, he just has a little problem
-but as a whole he is a perfect muhaddith, stick with him if it is not Asma wa Sifaat

There is a 3rd book by Al 3inee
-only resort to this book if you have a problem
-he is an old scholar from Egypt in Al 3inee
-he also wrote a book, but I don’t want to bother you with it
-I just want you to know there is a third book and there are many other books
-but the best book is Fath al Baari by ibn Hajar

Imam Shaafi once said Allah refused to allow,
-any book to be complete from cover to cover but Qur'an
-therefore if I say read Sharh am referring you to a book that is not perfect
-any book other than Qur’an you will always have hiccups

If we talk about sahih Muslim,
-where do we find its Sharh? it is in a book Sharh Sahih Muslim by the imam An Nawawi
-he is the one that put chapters in the book, his sharh is wonderful if you ask me
-the 40 hadith that were selected by him
-covered a lot of things like Actions are by intentions

Imam Nawawi also has a problem
-initially he was Asha’ira, he is not bad and was a top scholar, but no book is complete
-he was also a little bit biased towards Imam Muslim
-naturally he selected sahih Muslim of all the books
-and he was so nervous when he sees anything negative in it

I agree with him in some instances
-but there is a hadith in Muslim that was talking about Abu Sufyan
-he was the leader of Quraish’s army before becoming Muslim
-he then became Muslim after Fath Mecca
-and a good Sahabi, May Allah have mercy on him

There is a hadith talking about him
-the rasul (SAW) married his daughter when she was in Habasha
-and the prophet wrote a letter to the Negus to tie the knot between them
-the rasul got engaged to her before hijra, this is a fact
-and then her father became a Muslim, this sequence is beyond doubt

Ibn Abbas reported that the Muslims neither looked to Abu Sufyan (with respect) nor did they sit in his company; he (Abu Sufyan) said to Allah's Apostle (may peace be upon him): Allah's Apostle, confer upon me three things. He replied in the affirmative. He (further) said: I have with me the most handsome and the best (woman) Umm Habiba, daughter of Abu Sufyan; marry her, whereupon he said: Yes. And he again said: Accept Mu'awiya to serve as your scribe. He said: Yes. He again said: Make me the commander (of the Muslim army) so that I should fight against the unbelievers as I fought against the Muslims. He said: Yes. Abu Zumnail said: If he had not asked for these three things from Allah's Apostle (may peace be upon him), he would have never conferred them upon him, for it was (his habit) to accede to everybody's (earnest) request. [Sahih Muslim, Book 31, Hadith #6095]

But the hadith said Abu Sufyan asked the rasul for things before he accepted Islam
-and one of them was to marry his daughter, Umm Habiba
-how can this be possible? how can he marry her again when they were already married?
-unless you want to say it’s another umm Habiba
-or he had another daughter with the same name
-but how can the prophet marry 2 sisters at the same time? this is illogical in anyway
-and cannot be authentic, ibn Hazim wrote about this hadith
-and said there is a man in the chain he does not trust

And then Imam Nawawi tried to make the hadith authentic
-but it cannot be authentic in anyway

There is a book called Al Ilzamat wa Al Tatabboa
-by Abu Ali Omar Al Daraqutni, this man is a big alim
-and has his own mu'alaf called sunan Darul Qutnee
-he was 100 years or more after Bukhari & Muslim

He said that if this hadith is authentic
-then this other hadith too should be authentic because it is the same sanad and one was accepted
-and he did the same for Muslim, what he did was to say if you remove one hadith because it has a pitfall
-then why do you accept another hadith with the same problem

For example accepting hearing from a Shaikh
-there is a long hadith, that says listen and obey even if the ruler hits you on the back
-this hadith is not in Bukhari
-it was by way of Hudhaifa ibn Yaman
-in this hadith Makhool never heard from Hudhaifa
-therefore we can’t take his hadith and so there is no hadith like that

"...You will listen to the Amir and carry out his orders; even if your back is flogged and your wealth is snatched, you should listen and obey." [Sahih Muslim, Book 20, Hadith #4554]

The deviants like the phrase ‘even if he hits your back’
-as if Islam is a religion where Muslims are waiting for scholars to hit their backs
-there was a woman who received da’wah about Islam
-she read the Qur'an and was accepting Islam and then she wrote a letter and said I don’t accept Islam
-because it gives the ruler the power to hit my back and I have to give him my money also
-this is fitrah that’s why she can’t accept it

And the rasul will never have said so
-he said if somebody tries to take your money, don’t give him
-and if he tries to kill you in the process, kill him

It was narrated that Abu Hurayrah (may Allaah be pleased with him) said: A man came to the Messenger of Allaah (peace and blessings of Allaah be upon him) and said: O Messenger of Allaah, what do you think if a man comes wanting to take my property? He said: “Do not give him your property.” He said: What if he fights me? He said: “Fight him.” He said: What if he kills me? He said: “Then you will be a martyr.” He said: What if I kill him? He said: “He will be in Hell.” Narrated by Muslim (140)

-so how can the prophet say this and then change his mind?
-this particular hadith Darul Qutnee said is not part of the hadith
-and he gave his reasons, so if one of the Saudi salafis comes to you, don’t take his word for it

Imam Nawawi said there is another way to get to this hadith

-there is a book written on Sahih Muslim
-by one of their own shaikhs and that man said I can’t find a way to accept what Nawawi said
-it’s against dignity for this hadith to be true, the prophet will never say that
-we accept Hudhaifa ibn Yaman's ahadith but not this one

So we have Sahih Bukhari, Fath ul Bari
-sahih Muslim and sharh Nawawi

There is also a book, Al Dibaaj written by Imam Suyuti
-also on sahih Muslim, but not everything that he says is taken on face value
-he was Soofi and some things he wrote had problems, but he was an Imam

I called him the computer of Islam
-he wrote tafseer, hadith, Ulumul hadith and a genius in Arabic
-he actually wrote a book without the letter 'W' in it
-Ali did this before and he wrote a khutba without the letter Hamza

Imam Suyuti said ibn Arabi was a scholar
-this man was a kaafir because he believed in wahdatul wujud
-he said he could see the prophet
-not ibn Arabi al Maliki who is different

Imam Suyuti’s view of some of the ahadith had problems
-so I will say stick with Imam Nawawi's sharh

There are many books written on the sunans
-Tohfatol Ahwathi bi sharh sunan al Tirmidhi
-written by Al Mubarak Foori

-There are also books available that you should be aware of
-I mentioned some before and we will talk about them one at a time
-I will also give you the chance to find about other books
-today the tablets I wanted to give you are Fath ul Bari & Sharh Nawawi
-these 2 are the most important for me now and I want you to know the names


1. Brother I didn’t understand should we be against imam Nawawi’s sharh on the hadith or?
-no you should not be against the hadith in general
-you should not be against the sharh in general
-but there are few points that even you will not be convinced about
-like the issue of Abu Sufyan’s Islam
-all I am saying is be aware, don’t take things for granted
-because you may be fooled
-like the hadith on hitting the back
-Sahabah will even never accept that

Last time I said if someone gives you the name of a book
-go to the internet and ask Shaikh Faisal
-about the authenticity of the book
-I told you to ask about the book
-and if he says he does not recommend that book then be careful
-am saying this because Shaikh Faisal has gone through
-all the names of the books of ASWJ
-at some stage in his life
-so if he tells you the book is authentic then go back
-to that person and continue the argument, but if not end it there

2. I heard a famous book Al Bidaya Wannihaya what do shaikh Faisal say about this book?
-it is a history book not hadith book
-so you have to be careful what you read from it
-there are things that should not be taken from it
-it is taken as a history book not hadith
-so do we accept this book?
-if something is written by Abo Makhnaf (Lot ibn Yahya)
-do we accept it? the answer is no, he was a big Shia liar
-Ibn Kathir used him because it is a history book
-ibn Kathir did not say it is a sahih

If we are given a hadith that we want to know its verdict
-it is fard kifaaya to have an alim
-there has to be a scholar but not every person have to be a scholar
-so if we have Shaikh Faisal we have a scholar
-I don’t have to be a scholar
-unless after long time when he departs from this world
-then it becomes fard for one of us to take the flag and carry on in the room
-Allah said:

Let there arise out of you a group of people inviting to all that is good (Islām), enjoining Al-Ma'rûf (i.e. Islāmic Monotheism and all that Islām orders one to do) and forbidding Al-Munkar (polytheism and disbelief and all that Islām has forbidden). And it is they who are the successful. (Aali Imran 3:104)

-but it is fard ayn to seek knowledge
-it’s not enough for you to say I heard that from a shaikh

3. The ulama are the inheritors of the prophets like in the hadith?

All in the heavens and earth and the fish in the depth of the water seek forgiveness for the scholar, and the superiority of the scholar over the worshipper is like the superiority of the full moon at night over the rest of the stars. Verily the scholars are the heirs to the Prophets. Verily, the Prophets did not bequeath deenars or dirhams. All they left behind was knowledge, so whoever takes it, has indeed acquired a huge fortune. [Musnad Ahmad (v5/p196) #21763; Also related by Abu Dawud (v2/p341) #3641; at-Tirmidhi (v5/p48) #2682; Ibn Majah (v1/p150) #223, ad-Daarimee (v1/p110) #342 and ibn Hibbaan (v1/p289) #88]

-yes they are, but does that make them Anbiya? does that make them infallible? No
-so you should seek knowledge yourself
-the Shaikh will guide you as to which books to read

Sometimes if am not working I sit down and listen to him
-and wallahi I learnt a lot from him
-and sometimes I hear him quote a hadith I never heard
-I go to my books and look it up
-and if there is something I should tell him I will do
-because nobody is infallible
-so we go back and look at the books and learn
-to prepare for the grave

3. But the burden is on the Albani?

-the burden is on you
-Imam Ahmad used to wonder
-people are saying Ahmad said and Sufyan said
-but they are not asking where we got our information from
-we are talking about the president of Sunnah
-and yet he is saying people should ask him

Ibn Mas’ood said don’t imitate anybody
-we are not Christians or Jews
-who believe their Ulama are infallible
-and we don’t believe our Imams are infallible
-infallibility lies with the Prophet (SAW)

Imam Shaafi used to say my opinion is wrong but may be right
-other people’s opinion is right but may be wrong
-and we are talking about the mountains of Islam
-and they are saying these statements
-Imam Malik was asked 95 questions and he answered 5
-in the rest he said; don’t take our backs as a bridge to hell

Imam Abu Hanifa said if the hadith is authentic,
-then that is what I belief
-the proper scholars never said they are infallible
-they said ‘we don’t know’

Imam Ahmad never wrote a tafseer
-this is the man who memorized million hadith
-and naturally the Qur’an was in his heart
-and so was Imam Ibn Maeen
-he concentrated on Ta’deel

Imam Shaafi said all the people are students compared to Abu Hanifa
-and he was close to Anas ibn Malik time wise
-but he never wrote a tafseer

Albaani wrote a book Discouraging Taqleed
-so where did you get your taqleed from?
-we are not Shia or Soofi
-there is nothing called taqleed in Islam

When those who were followed, disown (declare themselves innocent of) those who followed (them), and they see the torment, then all their relations will be cut off from them. (Al-Baqarah 2:166)
