TAFSEER SURAH FURQAN (63-69)
ZINA CAUSES MURDER

AYAH 63

وَعِبَادُ الرَّحْمَنِ الَّذِينَ يَمْشُونَ عَلَى الْأَرْضِ هَوْنًا وَإِذَا خَاطَبَهُمُ الْجَاهِلُونَ قَالُوا سَلَامًا

And the slaves of the Most Beneficent (Allah) are those who walk on the earth in humility and sedateness, and when the foolish address them (with bad words) they reply back with mild words of gentleness. (Al-Furqan 25:63)

When the jahil try to involve the pious in fitnaa, the pious reply in gentleness- the jahil have nothing to lose, so we cannot debate with them in useless conversations
- the ummah must be alert and know their plots and plans - say SALAAM and then ignore them
- this conversation will only make us look bad in the sight of others

Luqman, the Wise told his son- do not walk in the earth in a proud manner
- see 31: 18

"And turn not your face away from men with pride, nor walk in insolence through the earth. Verily, Allah likes not each arrogant boaster. (Luqman 31:18)
Luqman, the Wise was grooming his son to be a proper da'ee in the society


AYAH 64
وَالَّذِينَ يَبِيتُونَ لِرَبِّهِمْ سُجَّدًا وَقِيَامًا

And those who spend the night before their Lord, prostrate and standing. (Al-Furqan 25:64)


- the Qur'an always has one ayah resembling the other ayah

Verily! In the creation of the heavens and the earth, and in the alternation of night and day, there are indeed signs for men of understanding. (Aali Imran 3:190)

Those who remember Allah (always, and in prayers) standing, sitting, and lying down on their sides, and think deeply about the creation of the heavens and the earth, (saying): "Our Lord! You have not created (all) this without purpose, glory to You! (Exalted be You above all that they associate with You as partners). Give us salvation from the torment of the Fire. (Aali Imran 3:191)

- see also 32:16

Their sides forsake their beds, to invoke their Lord in fear and hope, and they spend (charity in Allah's Cause) out of what We have bestowed on them. (As-Sajdah 32:16)

The righteous spend their time in qiyam and sajdah as we see 25:64 with 32:16
- the Rasool prayed at night till his legs were swollen

'Aishah (RA) said: The Prophet (SAW) would stand (in prayer) so long that the skin of his feet would crack. I asked him, "Why do you do this while your past and future sins have been forgiven?" He said, "Should I not be a grateful slave of Allah?" [al-Bukhari (4837) and Muslim (2820)]
- but he felt his prayers were a thanks to Allah 'tala
- for His goodness in forgiving his mistakes (past and future)
- this is why salah and humility are the characteristics of a righteous servant
- Pride is an attribute of the shaitan

It Is narrated on the authority of Abdullah b. Mas'ud that the Apostle of Allah (SAW), observed: He who has in his heart the weight of a mustard seed of pride shall not enter Paradise. A person (amongst his hearers) said: Verily a person loves that his dress should be fine, and his shoes should be fine. He (the Holy Prophet) remarked: Verily, Allah is Graceful and He loves Grace. Pride is disdaining the truth (out of self-conceit) and contempt for the people. [Sahih Muslim (1/93) No. 91]

THE RIGHTEOUS ARE:1. HUMBLE
2. LEVEL-HEADED
3. SEEK REFUGE FROM THE TORMENT OF THE HELLFIRE


AYAH 65
وَالَّذِينَ يَقُولُونَ رَبَّنَا اصْرِفْ عَنَّا عَذَابَ جَهَنَّمَ إِنَّ عَذَابَهَا كَانَ غَرَامًا

And those who say: "Our Lord! Avert from us the torment of Hell. Verily! Its torment is ever an inseparable, permanent punishment." (Al-Furqan 25:65)


HELLFIRE is a permanent punishment- the Rasool (SAW) sought forgiveness 100x a day

Abu Huraira (RA) said: I heard the Messenger of Allah (SAW) saying, "I swear by Allah that I seek Allah's Pardon and turn to Him in repentance more than seventy times a day." [Sahih Bukhari (8/67) No. 6307, Musnad Ahmad (2/341) No. 8474, Sunan Ibn Majah (4/719) No. 3815, Sunan Tirmidhi (5/383) No. 3259]

Al-Agharr al-Muzani reported that the Messenger of Allah (SAW) said, "A cloudiness comes over my heart and I ask for Allah's forgiveness a hundred times a day." [Sahih Muslim (4/2075) No. 2702, Musnad Ahmad (4/211) No. 17881, Sunan Abu Dawud (2/84) No. 1515]

Surely! Those who disbelieved in Our Ayat (proofs, evidences, verses, lessons, signs, revelations, etc.) We shall burn them in Fire. As often as their skins are roasted through, We shall change them for other skins that they may taste the punishment. Truly, Allah is Ever Most Powerful, All­Wise. (An-Nisa 4:56)

Ibn Taymiyyah said the Hellfire and Jahannam will go out- what did he mean by this?
- the section of Hellfire where the Muslims are kept before they go to Paradise will go out
- (only that part) we come out of Hellfire through the intercession of the Rasool (SAW)

Narrated By Anas: The Prophet said, "Allah will gather the believers on the Day of Resurrection in the same way (as they are gathered in this life), and they will say, 'Let us ask someone to intercede for us with our Lord that He may relieve us from this place of ours.' Then they will go to Adam and say, 'O Adam! Don't you see the people (people's condition)? Allah created you with His Own Hands and ordered His angels to prostrate before you, and taught you the names of all the things. Please intercede for us with our Lord so that He may relieve us from this place of ours.' Adam will say, 'I am not fit for this undertaking' and mention to them the mistakes he had committed, and add, "But you d better go to Noah as he was the first Apostle sent by Allah to the people of the Earth.' They will go to Noah who will reply, 'I am not fit for this undertaking,' and mention the mistake which he made, and add, 'But you'd better go to Abraham, Khalil Ar-Rahman.' They will go to Abraham who will reply, 'I am not fit for this undertaking,' and mention to them the mistakes he made, and add, 'But you'd better go to Moses, a slave whom Allah gave the Torah and to whom He spoke directly' They will go to Moses who will reply, 'I am not fit for this undertaking,' and mention to them the mistakes he made, and add, 'You'd better go to Jesus, Allah's slave and His Apostle and His Word (Be: And it was) and a soul created by Him.' They will go to Jesus who will say, 'I am not fit for this undertaking, but you'd better go to Muhammad whose sins of the past and the future had been forgiven (by Allah).' So they will come to me and I will ask the permission of my Lord, and I will be permitted (to present myself) before Him. When I see my Lord, I will fall down in (prostration) before Him and He will leave me (in prostration) as long as He wishes, and then it will be said to me, 'O Muhammad! Raise your head and speak, for you will be listened to; and ask, for you will be granted (your request); and intercede, for your intercession will be accepted.' I will then raise my head and praise my Lord with certain praises which He has taught me, and then I will intercede. Allah will allow me to intercede (for a certain kind of people) and will fix a limit whom I will admit into Paradise.

I will come back again, and when I see my Lord (again), I will fall down in prostration before Him, and He will leave me (in prostration) as long as He wishes, and then He will say, 'O Muhammad! Raise your head and speak, for you will be listened to; and ask, for you will be granted (your request); and intercede, for your intercession will be accepted.' I will then praise my Lord with certain praises which He has taught me, and then I will intercede. Allah will allow me to intercede (for a certain kind of people) and will fix a limit to whom I will admit into Paradise, I will return again, and when I see my Lord, I will fall down (in prostration) and He will leave me (in prostration) as long as He wishes, and then He will say, 'O Muhammad! Raise your head and speak, for you will be listened to, and ask, for you will be granted (your request); and intercede, for your intercession will be accepted.' I will then praise my Lord with certain praises which He has taught me, and then I will intercede. Allah will allow me to intercede (for a certain kind of people) and will fix a limit to whom I will admit into Paradise. I will come back and say, 'O my Lord! None remains in Hell (Fire) but those whom Qur'an has imprisoned therein and for whom eternity in Hell (Fire) has become inevitable.'"

The Prophet added, "There will come out of Hell (Fire) everyone who says: 'La ilaha illal-lah,' and has in his heart good equal to the weight of a barley grain. Then there will come out of Hell (Fire) everyone who says: ' La ilaha illal-lah,' and has in his heart good equal to the weight of a wheat grain. Then there will come out of Hell (Fire) everyone who says: 'La ilaha illal-lah,' and has in his heart good equal to the weight of an atom (or a smallest ant)." [Sahih Bukhari (9/121) No. 7410]


HELLFIRE - permanent for the kuffaar (they have no one to intercede for them)- the section of Hellfire with the Sikhs, Hindus and unbelievers will NEVER go out
- intercession is for the sincere believers

On the authority of Abu Huraira (RA) the Messenger of Allah said, "For every Prophet there is one invocation which is definitely fulfilled by Allah, and I wish, if Allah will, to keep my that (special) invocation as to be the intercession for my followers on the Day of Resurrection." [al-Bukhari (7474) and Muslim (198)]
ALL PROPHETS BEFORE MUHAMMAD (SAW) used their dua in the dunya- be he saved his, to intercede for us in the aakhirah


AYAH 66
إِنَّهَا سَاءَتْ مُسْتَقَرًّا وَمُقَامًا

Evil indeed it (Hell) is as an abode and as a place to dwell. (Al-Furqan 25:66)


AYAH 67

وَالَّذِينَ إِذَا أَنْفَقُوا لَمْ يُسْرِفُوا وَلَمْ يَقْتُرُوا وَكَانَ بَيْنَ ذَلِكَ قَوَامًا

And those, who, when they spend, are neither extravagant nor niggardly, but hold a medium (way) between those (extremes). (Al-Furqan 25:67)

- see also 17:29 which resembles 25:67

And let not your hand be tied (like a miser) to your neck, nor stretch it forth to its utmost reach (like a spendthrift), so that you become blameworthy and in severe poverty. (Al-Isra 17:29)

If we give all our wealth away in charity, we will be poverty stricken like those who beg us
- so learn how to say NO, strike a balance between the two extremes


AYAH 68


وَالَّذِينَ لَا يَدْعُونَ مَعَ اللَّهِ إِلَهًا آخَرَ وَلَا يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللَّهُ إِلَّا بِالْحَقِّ وَلَا يَزْنُونَ وَمَنْ يَفْعَلْ ذَلِكَ يَلْقَ أَثَامًا

And those who invoke not any other ilah (god) along with Allah, nor kill such life as Allah has forbidden, except for just cause, nor commit illegal sexual intercourse and whoever does this shall receive the punishment. (Al-Furqan 25:68)

We are not allowed to KILL unless it is a just cause- may Allah 'tala guide the Barelvis because they invoke others
- same as Shiites, who invoke others besides Allah 'tala
- they do not belong to the Ummah of Muhammad

Nu’man ibn Bashir (RA) narrated the Prophet (SAW) said, “The supplication is itself worship.” Then he recited. And your Lord says, “Call upon Me, and I shall answer you. Surely those who are too arrogant to worship Me, they shall enter Hell, disgraced.” (40: 60) [Tirmidhi (5/456) No. 3372, Abu Dawud (2/76) No. 1479, Ibn Majah (5/5) No. 3828, Ahmad (4/271) No. 18410]

Allah 'tala dismissed Shia, Soofi and Barelvis as liars and kaafirs- see 39:3

Surely, the religion (i.e. the worship and the obedience) is for Allah only. And those who take Auliya' (protectors and helpers) besides Him (say): "We worship them only that they may bring us near to Allah." Verily, Allah will judge between them concerning that wherein they differ. Truly, Allah guides not him who is a liar, and a disbeliever. (Az-Zumar 39:3)

Abu Huraira narrated that the Prophet said, "On the Day of Resurrection a group of companions will come to me, but will be driven away from the Lake-Fount, and I will say, 'O Lord (those are) my companions!' It will be said, 'You have no knowledge as to what they innovated after you left; they turned apostate as renegades (reverted from Islam)." [Sahih Bukhari, Vol 8, Book 76, Hadith #585]

We use this hadeeth to debate Shiites, Soofis and Barelvis - these are grave worshippers!- they have no excuse of ignorance
- we cannot give ignorance as an excuse to those who worship besides Allah 'tala

EVIDENCES:- see 5:72-73

Surely, they have disbelieved who say: "Allah is the Messiah ['Iesa (Jesus)], son of Maryam (Mary)." But the Messiah ['Iesa (Jesus)] said: "O Children of Israel! Worship Allah, my Lord and your Lord." Verily, whosoever sets up partners in worship with Allah, then Allah has forbidden Paradise for him, and the Fire will be his abode. And for the Zalimûn (polytheists and wrong­doers) there are no helpers. (Al-Ma'idah 5:72)
Surely, disbelievers are those who said: "Allah is the third of the three (in a Trinity)." But there is no ilah (god) (none who has the right to be worshipped) but One Ilah (God -Allah). And if they cease not from what they say, verily, a painful torment will befall the disbelievers among them. (Al-Ma'idah 5:73)
CHRISTIANS say Jesus the son of Mary is Allah 'tala- and they were not given the excuse of ignorance

7 CONDITIONS OF SHAHADAH1. KNOWLEDGE
2. CERTAINTY
3. BELIEVE IN OUR HEART AND ALSO DECLARE WITH OUR TONGUE
4. SURRENDER TO QUR'AN AND SUNNAH (both)
5. CONDEMN ALL SHADES OF FALSEHOOD
6. SINGLE OUT ALLAH 'TALA FOR YOUR DEVOTION
7. AL WALAA WAL BARAA

Say (O Muhammad SAW): "Verily, my Salat (prayer), my sacrifice, my living, and my dying are for Allah, the Lord of the 'Alamin (mankind, jinns and all that exists). (Al-An'am 6:162)
- if you pray to the graves, you have nullified your Shahadah
- because you did not single out ALLAH for devotion

DUA IS AN ACT OF WORSHIP

-SO WE CANNOT OFFER IT TO ANYONE BUT ALLAH (see above hadeeth)

And (remember) when your Lord brought forth from the Children of Adam, from their loins, their seed (or from Adam's loin his offspring) and made them testify as to themselves (saying): "Am I not your Lord?" They said: "Yes! We testify," lest you should say on the Day of Resurrection: "Verily, we have been unaware of this." (Al-A'raf 7:172)
- in surah 7:172 Allah told us that HE made us testify to HIS Lordship
- hence we promised to worship HIM alone
- we have no excuse to commit shirk
- we are not allowed to pray for our kaafir relatives - see 9:113

It is not (proper) for the Prophet and those who believe to ask Allah's Forgiveness for the Mushrikûn (polytheists, idolaters, pagans, disbelievers in the Oneness of Allah) even though they be of kin, after it has become clear to them that they are the dwellers of the Fire (because they died in a state of disbelief). (At-Tawbah 9:113)
- they died as pagans and hence we should not pray for them
- mushirkeen = pagan, polytheist and idolaters (English equivalent)
- the rasul (SAW) could not even pray for Allah to take his uncle out of hell
- because of the ayah (9:113)

Narrated By Al-Abbas bin 'Abdul Muttalib: That he said to the Prophet "You have not been of any avail to your uncle (Abu Talib) (though) by Allah, he used to protect you and used to become angry on your behalf." The Prophet said, "He is in a shallow fire, and had It not been for me, he would have been in the bottom of the (Hell) Fire." [Sahih Bukhari, Vol 5, Book 58, Hadith #222]

Ibn 'Abbas reported: The Prophet (may peace be upon him) said: Among the inhabitants of the Fire Abu Talib would have the least suffering, and he would be wearing two shoes (of Fire) which would boil his brain. [Sahih Muslim, Book 1, Hadith #0413]

- you should not murder

Because of that We ordained for the Children of Israel that if anyone killed a person not in retaliation of murder, or (and) to spread mischief in the land - it would be as if he killed all mankind, and if anyone saved a life, it would be as if he saved the life of all mankind. And indeed, there came to them Our Messengers with clear proofs, evidences, and signs, even then after that many of them continued to exceed the limits (e.g. by doing oppression unjustly and exceeding beyond the limits set by Allah by committing the major sins) in the land!. (Al-Ma'idah 5:32)

- but we can kill Muslims under the Islamic law
- this is done by the caliph in the Islamic state


THE 13 MUSLIMS WE ARE ALLOWED TO KILL
1. MURDERER
- bury him in the graveyard of the Muslims because he is not a kaafir
- only the khawaarij have the aqeedah
- he is only a fasiq

Narrated By 'Abdullah: Allah's Apostle said, "The blood of a Muslim who confesses that none has the right to be worshipped but Allah and that I am His Apostle, cannot be shed except in three cases: In Qisas for murder, a married person who commits illegal sexual intercourse and the one who reverts from Islam (apostate) and leaves the Muslims." [al-Bukhari (6878) and Muslim (1676)]

2. MURTAD (APOSTATE)
- he is buried in the graveyard of the kuffaar
- there are a lot of murtads in Europe but you cannot kill them

On the authority of Ibn Abbas (RA) narrated the Messenger of Allah (SAW) said: "If somebody (a Muslim) discards his religion, kill him." [Sahih Bukhari (4/61) No. 3017, Musnad Ahmad (1/322) No. 2968, Sunan al-Nasa'i (7/104) No. 4059, Sunan Ibn Majah (3/574) No. 2535, Sunan Abu Dawud (4/126) No. 4351, Sunan Tirmidhi (4/59) No. 1458]
- democracy gives you the freedom to change your deen to kufr
- so there is nothing you can do about even if she is your daughter
- in the Islamic state you are free to choose Islam, but you are not free to leave it
- an Islamic scholar should reason with the apostate to bring him back to Islam
- the Saudi who insulted the prophet (SAW) in twitter

3. ADULTERER
- this can only be done in the Islamic state too
- hudood (Islamic capital punishment)
- the four great imams agree that it should only be applied in the Islamic state
- they campaign for GAY RIGHTS on MARDI GRAS in Louisiana (US)
- there are many gays in USA and Europe but you cannot touch them
- before you can kill the adulterer, 4 witnesses should find the pen in the ink
- and should be asked individually as to what the sexual position they was in
- if they differ in anything then you throw the case out of court
- and give them (witnesses) 80 lashes each
- or if the adulterer confesses
- in the time of Umar (RA) Mugheera Ibn Shu'bah was accused of zina
- but the witnesses differed so the case was thrown out of court
- and were given 80 lashes as slanderers
- no statement will be accepted from them

The case of Mughirah bin Shu`bah, in which `Umar punished Abu Bakrah and the other two eye-witnesses on the charge of false accusation. A critical study of the entire case shows that this precedent is not applicable to every case where the crime is not proved by proper evidence

The facts of the case are that Mughirah bin Sh u`bah, the Governor of Basrah, did not have good relations with Abu Bakrah, whose house was opposite to his house across the same street. One day the windows of the two houses were opened by a strong current of wind. When 'Abu Bakrah got up to close his window, he saw through the opposite window across the street Mughirah in a state of actual sexual intercourse. He asked three of his friends (Naf`i bin Kaladah, and Shibl bin Ma`bad) who were also sitting with him to stand up and witness what Mughirah was doing. The friends asked him who was the woman. Abu Bakrah. said that she was Umm Jamil. The next day a complaint to this effect was sent to `Umar, who immediately suspended Mughirah and appointed Abu Musa Ash`ari as Governor of Basrah. Mughirah along with the witnesses was called to Al-Madinah. When they were asked about the case, Abu Bakrah said that they had seen Mughirah actually committing sexual intercourse with Umm Jamil, but Ziad said that the woman was not clearly visible and that he could not say definitely whether it was Umm Jamil or not. During the cross examination, Mughirah proved that they could not have seen the woman distinctly from the place where they were standing. He also proved that there was a close resemblance between his wife and Umm Jamil. Besides this, circumstantial evidence also showed that during the Caliphate of `Umar, the governor of a province could not have committed this crime in his official residence, especially when his wife was also living with him. Thus the supposition of Abu Bakrah and his companions that Mughirah was having sexual intercourse with Umm Jamil, instead of his own wife, was nothing but a misplaced suspicion. It was for this reason that `Umar not only acquitted the accused but also punished Abu Bakrah, Naf`i and Shibl as slanderers. It is obvious that this isolated decision was based on the specific circumstances of the case and not on the principle that the witnesses must be' punished when they are not able to prove the charge by their evidence. (For details of this case, see Ahkam al-Qur'an, Ibn al-`Arabi, Vol. II, pp. 88, 89).


4. DRUG SMUGGLER

The recompense of those who wage war against Allah and His Messenger and do mischief in the land is only that they shall be killed or crucified or their hands and their feet be cut off on the opposite sides, or be exiled from the land. That is their disgrace in this world, and a great torment is theirs in the Hereafter. (Al-Ma'idah 5:33)
5. HIGHWAY ROBBER- if you pick someone’s pocket from the town centre, we chop off your hand
- but if you stick up a knife or point a gun, then you are crucified and killed

Narrated Anas: Some people from `Uraina tribe came to Medina and its climate did not suit them, so Allah's Apostle (SAW) allowed them to go to the herd of camels (given as Zakat) and they drank their milk and urine (as medicine) but they killed the shepherd and drove away all the camels. So Allah's Apostle sent (men) in their pursuit to catch them, and they were brought, and he had their hands and feet cut, and their eyes were branded with heated pieces of iron and they were left in the Harra (a stony place at Medina), till they died. [al-Bukhari (6802) and Muslim (1671)]

- this ayah (5:33) is used for the drug smuggler and armed robber
- a man who crucified in KSA was from the tribe of Ahmad Ibn Hanbal (shaibaan)
- this was mentioned on TV

6. HOMOSEXUALS
There is a difference of opinion concerning the punishment for the one who commits sodomy. The following are the opinions that were mentioned by Imam Ash-Shawkani in "Nayl Al-Awtar", Vol. 7/p122-124.
1) That he is killed with the sword, then burnt. This is narrated from Abu Bakr and 'Ali Ibn Abi Talib.
2) That a wall should be collapsed upon him. This was the opinion of 'Umar and 'Uthman.
3) That he should be thrown from the highest building in the city, then that should be followed up with him being pelted with rocks. This was the opinion of Ibn 'Abbas.
4) That he is stoned. This is narrated by Al-Bayhaqi from 'Ali Ibn Abi Talib, Ash-Sha'bi, Az-Zuhri, Malik, Ahmad, Is'haq, and Ash-Shafi'i.
5) That they are burned. This was narrated by Al-Bayhaqi, that Abu Bakr gathered the Sahabah and 'Ali mentioned this, and the Sahabah agreed upon it. It was also mentioned by Al-Munthiri that it was done by Abu Bakr, 'Ali, 'Abdullah Ibn Az-Zubayr, and Hisham Ibn 'Abdil-Malik.
6) That he is stoned, then burnt with fire. This is narrated from the Sahabah agreeing upon it in the time of Abu Bakr.
7) That the punishment is the same as Zina, in that if he is a virgin, he is whipped, and if he is not, then he is stoned.
8) That there is no prescribed punishment, rather it is left up to the Imam to perform Ta'zir, and this was narrated from Abu Hanifah, and one narration from Ash-Shafi'i, and others.
Ash-Shawkani refutes the opinion of the punishment being the same as Zina, as well as the opinion that there is only Ta'zir, and supports the opinion that he is killed, but does not appear to specify which way of killing is the strongest.


- they are stoned to death and their bodies are burned
- and no janazah prayed over them

Ibn ‘Abbas (RA) said: The Messenger of Allah (SAW) said: “Whoever you find doing the action of the people of Loot, execute the one who does it and the one to whom it is done.” [Sunan Tirmidhi (4/57) No. 1456, Sunan Abu Dawud (4/158) No. 4462, Sunan Ibn Majah (3/594) No. 2561, Musnad Ahmad (1/300) No. 2732]

Ibn ‘Abbas (RA) that the Prophet of Allah (SAW) said: “May Allah curse the one who does the action of the people of Loot, may Allah curse the one who does the action of the people of Loot,” three times. [Musnad Ahmad (1/317) No. 2915, This was classed as hasan by Shu’ayb al-Arna’oot in Tahqeeq al-Musnad]
On the authority of Ibn ‘Abbas (RA) that the Prophet (SAW) cursed men who imitate women and women who imitate men, and he said: “Throw them out of your houses.” [Sahih Bukhari (7/159) No. 5885]
- a gay cannot be a Muslim, but some people argue otherwise, but if this was so;
- why did the caliphs burn their bodies and did not pray janazah over them?
- Ali had the opinion of burning them

- the highway robber, the adulterer, the drug smuggler are all fasiq, but not kaafirs
- so they are buried in the burial grounds of Muslims

Abdullah Ibn Umar (RA) reported that the Jews brought to the Prophet (SAW) a man and a woman who had committed (adultery) illegal sexual intercourse. He ordered both of them to be stoned (to death), near the place of offering the funeral prayers beside the mosque." [Sahih Bukhari (2/88) No. 1329]

7. THE SPY

Ibn al-Qayyim said: "The correct view is that execution of a spy depends on the opinion of the ruler; if executing him is in the Muslims’ interests, he should be executed, but if letting him live serves a greater interest, then he should be allowed to live. And Allah knows best." [Zad al-Ma'ad (3/372)]

8. RAPIST
- killing a rapist is a matter if ijtihad

The recompense of those who wage war against Allah and His Messenger and do mischief in the land is only that they shall be killed or crucified or their hands and their feet be cut off on the opposite sides, or be exiled from the land. That is their disgrace in this world, and a great torment is theirs in the Hereafter. (Al-Ma'idah 5:33)

- not every rapist is killed
- you are not allowed to kill a lesbian because their sex is fake, it is not real
- if you kill them you have made up your own religion

Ibn Qudamah said: "If two women engage in lesbian sexual relations, then they are guilty of zina and are cursed, because it was narrated that the Prophet (SAW) said: “If a woman has sexual relations with another woman, then they are both guilty of zina.” There is no hadd punishment for them because they did not have intercourse, rather it is likened to intimate relations that are less than intercourse, and they are to be subjected to a ta’zeer punishment." [al-Mughni (9/61)]


9. BESTIALITY

Narrated By Abdullah ibn Abbas: The Prophet (SAW) said: "If anyone has sexual intercourse with an animal, kill him and kill it along with him." I (Ikrimah) said: I asked him (Ibn Abbas): 'What offence can be attributed to the animal?' He replied: 'I think he (the Prophet) disapproved of its flesh being eaten when such a thing had been done to it.' [Sunan Abu Dawud (4/159) No. 4464, Sunan Tirmidhi (4/56) No. 1455, Musnad Ahmad (1/269) No. 2420]

10. INCEST
- the people involved in this should be killed
- if both are consenting adults and reached puberty

Narrated By Al-Bara' ibn Azib: I met my uncle who was carrying a standard. I asked him: 'Where are you going?' He said: 'The Apostle of Allah (SAW) has sent me to a man who has married his father's wife. He has ordered me to cut off his head and take his property.' [Sunan Abu Dawud (4/157) No. 4457, Sunan al-Nasa'i (6/109) No. 3332, Sunan al-Darime (2/205) No. 2239, Musnad Ahmad (4/290) No. 18580]
11. PAEDOPHILES- the imam decides when to kill them

'Aisha (RA) reported: "Whenever the Prophet (SAW) was given a choice between two matters, he would (always) choose the easier as long as it was not sinful to do so; but if it was sinful he was most strict in avoiding it. He never took revenge upon anybody for his own sake; but when Allah's Legal Bindings were outraged, he would take revenge for Allah's sake." [al-Bukhari (3560) Muslim (2327)]
12. THOSE WHO INSULT ALLAH 'TALA AND HIS RASOOL (SAW)
Hussain ibn Ali related from his father Ali Ibn Abi Talib that the Messenger of Allah (SAW) said: "Whoever curses a Prophet, kill him. Whoever curses my Companions, beat him." [al-Mu’jam al-Awsat al-Tabarani (5/35) No. 4602]

It was narrated that Abu Barzah Al-Aslami said: "A man spoke harshly to Abu Bakr As-Siddiq, and I said: 'Shall I kill him?' He rebuked me and said: 'That is not for anyone after the Messenger of Allah (SAW)"'. [Sunan Nasa'i (7/108) No. 4071]

Al-Imam Ishaq Ibn Rahawayh said: (All Muslims are in consensus that whoever curses Allah or curses His Messenger, or rejects something from what Allah revealed, or killed a prophet, that he is a kafir; and even if he accept what was revealed by Allah. And Al-Khattabi said, "I don't know of anyone who disagrees with the obligation of his killing." And Muhammad Ibn Sahnun said that the scholars are in consensus that the one who curses the Messenger is a Kafir; and whoever doubts his Kufr is a Kafir.) 13. THE MAGICIAN
- the hadd is one strike of the sword

Jundub (RA) reported that the Messenger of Allah (SAW) said: “The hadd (prescribed punishment) for the practitioner of magic is a blow with the sword (i.e., execution)" [Sunan Tirmidhi (4/60) No. 1460, Sunan al-Daraqutni (4/120) No. 3204, Mustadrak al-Haakim (4/401) No. 8073, al-Sunan al-Kabir al-Bayhaqi (8/234) No. 16500, al-Mu'jam al-Kabir al-Tabarani (2/161) No. 1665]

Bajaalah (RA) said: “Umar ibn al-Khattaab (RA) wrote to us commanding us to kill every sorcerer, male or female.” [Musnad Ahmad (1/190) No. 1657, Sunan Abu Dawud (3/168) No. 3043, al-Sunan al-Kabir al-Bayhaqi (9/318) No. 18652]


AYAH 69

يُضَاعَفْ لَهُ الْعَذَابُ يَوْمَ الْقِيَامَةِ وَيَخْلُدْ فِيهِ مُهَانًا

The torment will be doubled to him on the Day of Resurrection, and he will abide therein in disgrace; (Al-Furqan 25:69)

- your taubah is between you and Allah
- Allah mentioned murder and zina in the same ayah (ayah 68)
- because wherever zina is rife, murder will be rife
- a father will kill you for tarnishing the honour of the family (i.e. sleeping with his daughter)
- adulterer is stoned to death
- the ayah (was in ahzab) and Allah removed it but the ruling remains

Narrated Umar ibn al-Khattab: The Prophet said, "...Whenever a man is alone with a woman the Devil makes a third..." [Musnad Ahmad (1/26) No. 177, Sunan Tirmidhi (4/465) No. 2165, Mustadrak al-Haakim (1/197) No. 387, Sahih Ibn Hibban (12/399) No. 5586, Nasa'i in 'Sunan al-Kubra' (5/387) No. 9219]

- you should also stay away from the avenues to zina
- Imam Shafi’i said that zina is a debt you owe

Stay chaste and your women will be chaste, and save yourself from that which is unfit for a Muslim. Verily, adultery is a debt, if you have taken this debt, know that its payment will be taken from the people of your household. One who commits adultery, in return adultery will be commited with him, even though it will be commited against the wall of your house. O man! If you are wise then you should know it (Diwan Ash-Shafi'i)
Narrated Abu Huraira: The Prophet said, "An adulterer, at the time he is committing illegal sexual intercourse is not a believer; and a person, at the time of drinking an alcoholic drink is not a believer; and a thief, at the time of stealing, is not a believer." Ibn Shihab said: `Abdul Malik bin Abi Bakr bin `Abdur-Rahman bin Al- Harith bin Hisham told me that Abu Bakr used to narrate that narration to him on the authority of Abu Huraira. He used to add that Abu Bakr used to mention, besides the above cases, "And he who robs (takes illegally something by force) while the people are looking at him, is not a believer at the time he is robbing (taking). [al-Bukhari (5578) and Muslim (57)]

- the adulterer is not a mu'min when he is in the act with woman
- when he commits zina, he is still a Muslim
- only khawaarij say he is a kaafir when he is in the act
