-357- Importance of Fiqhul Waaqi

Fiqh = to understand
Waaqi = the current events

Tonight, we will study the current events on the ground

Fiqh an-Nass = to study the book
Fiqh ul-waaqi (current events)

A scholar should not pass a fatwa unless he knows both the book (Qur'an) and Waaqi
- when a scholar passes a fatwa without knowing fiqhul waaqi, he brings harm to the ummah
- it's better to ask your local shaikh questions concerning your local community
- instead of asking a Shaikh on Paltalk
- some of you prefer to ask someone who doesn't know you

Fiqhul waaqi is imperative to know to pass a fatwa

Ibn al-Qayyim (rh) said: The mufti or judge is not able to issue a fatwa or verdict without understanding two things: (i) Understanding and having a good grasp of reality: he should have a good understanding of what is happening, on the basis of circumstantial evidence and other signs, so that he has a full understanding of it. (ii) Understanding what is required in the light of these circumstances, which means understanding the ruling of Allah that He issued in His book or on the lips of His Messenger concerning this reality, then he should apply the one to the other. [I‘laam al-Muwaqqi‘een, 1/87]

- the shaikh on the internet needs to hear both sides of the story
- from the husband and from the wife

Imam Shafi'i passed different fatwas depending on the country he was in
- when a Shaikh is locked up in prison,
- he's not allowed to pass fatwas that are related to fiqhul waaqi
- if the fatwa is not connected to fiqhul waaqi, you can accept it
- on the outside of prison, things change rapidly on a daily basis
- if you've lost touch with current events, how can you pass judgment for the Muslims?

When a person is a tyrant or oppressor, they don't want you to listen to fiqhul waaqi
- because they don't want you to know how evil they are
- so they create an UNAWARE society

In Europe:
- soccer is turned into a 'religion' to create an unaware society
- this way, people don't march on Wall Street, or Sydney, AU or Berlin, Germany
- sports are designed to take you away from fiqhul waaqi so the taghoot leader is not toppled
- the same is true for the Olympics and other major sport events

When a person is a munafiq, they don't want you to pay attention to fiqhul waaqi as well
- they cement the thrones of the taghoot (Saudi Salafi, example)
- and say studying fiqhul waaqi is like studying the Injeel (Bible)

How many of you know what's happening in Yemen and that there's Shari’ah and peace?
- or Somalia or Occupied Kashmir or Occupied Palestine or Gaza
- did you know water is rationed in Gaza?
- so young and old people have kidney stones from so little water

Tawagheet don't want you to know these current evidences
- because it might interfere with their pay-masters

It was narrated from Abd-Allaah ibn Masood (RA) that the Prophet (SAW) said: "Whoever starts his day caring about something other than Allaah has nothing to do with Allaah, and whoever does not care about the Muslims is not one of them." [Narrated by al-Haakim in al-Mustadrak (4/356)]

Narrated by An-Nu'man bin Bashir: The Prophet (SAW) said: “The likeness of the believers in their mutual love, mercy and compassion is that of one body; when one part of it suffers, the rest of the body joins it in staying awake and suffering fever.” [al-Bukhaari (6011) and Muslim (2586)]

Allah said:

The believers, men and women, are Auliyā' (helpers, supporters, friends, protectors) of one another, they enjoin (on the people) Al-Ma'rûf (i.e. Islāmic Monotheism and all that Islām orders one to do), and forbid (people) from Al-Munkar (i.e. polytheism and disbelief of all kinds, and all that Islām has forbidden); they perform As-Salah (Iqāmat-as-Salah) and give the Zakat, and obey Allah and His Messenger. Allah will have His Mercy on them. Surely Allah is All-Mighty, All-Wise. (At-Tawbah 9:71)

MADkhali creed - think about yourself not the affairs of others
- 9:71 shows it’s important for us to pay attention to what's happening
- to our ummah in other parts of the world

And thus do We explain the Ayāt (proofs, evidences, verses, lessons, signs, revelations, etc.) in detail, that the way of the Mujrimûn (criminals, polytheists, sinners), may become manifest. (Al-An'am 6:55)

Allah 'tala doesn't want us to have the 'ostrich syndrome'
- dipping your head in the sand and then thinking the world is all fine
- we're to know the way of the criminals, the mushriks and the zindeeq
- so Allah 'tala has made the signs clear for us
- to know what they did to the prophets of old,
- and what they will do to us today

Qaroon paid a woman to say she slept with Prophet Musa
- because if the wicked people can't refute the truth, they assassinate your character

Allah said:

And indeed, We gave Musa (Moses) the Book and followed him up with a succession of Messengers. And We gave 'Iesa (Jesus), the son of Maryam (Mary), clear signs and supported him with Ruh-ul-Qudus [Jibrael (Gabriel)]. Is it that whenever there came to you a Messenger with what you yourselves desired not, you grew arrogant? Some, you disbelieved and some, you killed. (Al-Baqarah 2:87)

- the kuffaar killed Imam Awlaki (by a drone) and he was a sincere scholar
- they also killed his 16 year old son
- and tried to say he was 21 years old but he was only 16

Since they killed the prophets, and the scholars are the inheritors of the prophets,
- expect them to kill sincere scholars of today

“…Verily the scholars are the heirs to the Prophets. Verily, the Prophets did not bequeath deenars or dirhams. All they left behind was knowledge, so whoever takes it, has indeed acquired a huge fortune." [Musnad Ahmad (5/196) No. 21763; Also related by Abu Dawud (2/341) No. 3641; at-Tirmidhi (5/48) No. 2682; Ibn Majah (1/150) No. 223, ad-Daarimee (1/110) No. 342 and ibn Hibbaan (1/289) No. 88]

- Abu Hanifa was poisoned in prison
- we study fiqhul waaqi so we learn the MODUS OPERANDI of the criminals (how they operate)

Have they not travelled through the land, and have they hearts wherewith to understand and ears wherewith to hear? Verily, it is not the eyes that grow blind, but it is the hearts which are in the breasts that grow blind. (Al-Hajj 22:46)

Allah 'tala gave us an aql (intellect) to understand what's happening in the world;
- He (SWT) gave us ears and eyes
- but it's our hearts which go blind
- we only see what we want to see

Anas Ibn Malik narrated the Messenger of Allah (SAW) said: "A believer is shrewd, sharp and careful." [Quda'ee (d. 454 H) in 'Musnad al-Shihab' (Vol. 1 pg. 107) No. 128]

Abu Huraira (RA) narrated the Prophet (SAW) said: "A believer is not bitten from the same hole twice.” [Related by al-Bukhari (6133) and Muslim (2998)]

The worst blindness is the blindness of the heart;
- a munafiq sees what he wants to see, hear what he wants to hear
- and remember what he wants to remember
- they have 'selective amnesia'

When we don't pay attention to fiqhul waaqi, we suffer
- we're told to travel through the land and know the events on the ground
- we need to hear what goes on in Syria,
- Occupied Palestine, Somalia, Libya, Iraq, Afghanistan and Yemen
- hadeeth means 'the news'

“…There is a lump of flesh in the body, the nature of which is that when it is sound, the entire body is sound, and when it is corrupt, the entire body is corrupt - it is the heart.'" [al-Bukhari (52) and Muslim (1599)]

If we're blind we won't see truth as truth and falsehood as falsehood
- when the shaytan controls heart, soul and mind, we can't see truth

Anas ibn Malik (RA) narrated the Messenger of Allah (SAW) said, ‘The time of the Dajjal will be years of confusion. People will believe a liar, and disbelieve one who tells the truth. People will distrust one who is trustworthy, and trust one who is treacherous; and the Ruwaybidah will have a say.’ Someone asked, ‘Who are the Ruwaybidah?’ He said, ‘Those who rebel against Allah and will have a say in general affairs.’” [Musnad Ahmad (3/220) No. 13322]

A sign of the last days is that someone speaking truth
- will be seen as falsehood and vice-versa

Allah said:

O you who believe! If a rebellious evil person comes to you with a news, verify it, lest you harm people in ignorance, and afterwards you become regretful to what you have done. (Al-Hujurat 49:6)

If you're a commander, it's important to learn fiqhul waaqi



…Then, can they expect anything (else), but the Sunnah (way of dealing) of the peoples of old? So no change will you find in Allah’s Sunnah (way of dealing), and no turning off will you find in Allah’s Sunnah (way of dealing). (Fatir 35:43)

- we have natural disasters that are signs from Allah 'tala
- and His (SWT)’s punishments (Hurricane Katrina in US and Tsunami in Indonesia)


And indeed he (Satan) did lead astray a great multitude of you. Did you not, then, understand? (Ya-Sin 36:62)


So set you (O Muhammad SAW) your face towards the religion of pure Islāmic Monotheism Hanifa (worship none but Allah Alone) Allah’s Fitrah (i.e. Allah’s Islāmic Monotheism), with which He has created mankind. No change let there be in Khalq illāh (i.e. the Religion of Allah Islāmic Monotheism), ... that is the straight religion, but most of men know not. [Tafsir At Tabarī, Vol 21, Page 41] (Ar-Rum 30:30)

The people in the time of Prophet Nuh worshiped idols
- and we have this today (the people worshiping Buddhist statues)
- people worship idols because idols can't tell them what to do
- they can escape haakimiyya this way
- people who worship their own corrupted desires become atheists and pagans
- we had homosexuals in the time of Prophet Lut and we have them today
- in the time of Prophet Musa, people did black magic (we have this today)
- and dabbling in black magic makes you a kaafir so this is a serious sin

They followed what the Shayatin (devils) gave out (falsely of the magic) in the lifetime of Sulaiman (Solomon). Sulaiman did not disbelieve, but the Shayatin (devils) disbelieved, teaching men magic and such things that came down at Babylon to the two angels, Harut and Marut, but neither of these two (angels) taught anyone (such things) till they had said, "We are only for trial, so disbelieve not (by learning this magic from us)." And from these (angels) people learn that by which they cause separation between man and his wife, but they could not thus harm anyone except by Allah's Leave. And they learn that which harms them and profits them not. And indeed they knew that the buyers of it (magic) would have no share in the Hereafter. And how bad indeed was that for which they sold their ownselves, if they but knew. (Al-Baqarah 2:102)

Jundub (RA) reported that the Messenger of Allah (SAW) said: “The hadd (prescribed punishment) for the practitioner of magic is a blow with the sword (i.e., execution)" [Sunan Tirmidhi (4/60) No. 1460, Sunan al-Daraqutni (4/120) No. 3204, Mustadrak al-Haakim (4/401) No. 8073, al-Sunan al-Kabir al-Bayhaqi (8/234) No. 16500, al-Mu'jam al-Kabir al-Tabarani (2/161) No. 1665]

Bajaalah (RA) said: “Umar ibn al-Khattaab (RA) wrote to us commanding us to kill every sorcerer, male or female.” [Musnad Ahmad (1/190) No. 1657, Sunan Abu Dawud (3/168) No. 3043, al-Sunan al-Kabir al-Bayhaqi (9/318) No. 18652]

When Umar was the caliph, he wrote letters to the Muslim provinces
- to kill every practioner of magic
- spying for the kuffaar makes you a kaafir also
- in the time of Prophet Muhammad (pbuh), they used the entertainment industry
- to pour scorn on Islam

And of mankind is he who purchases idle talks (i.e. music, singing, etc.) to mislead (men) from the Path of Allah without knowledge, and takes it (the Path of Allah, the Verses of the Qur’an) by way of mockery. For such there will be a humiliating torment (in the Hell-fire). (Luqman 31:6)

DENZEL WASHINGTON starred in a movie called SIEGE
- the movie was made by Jews to pour scorn on Islam
- DELTA FORCE was also made by them and for the same reason
- a man went to Persia and brought back singing girls
- and told the people to listen to them and not Qur'an or the Prophet (SAW)
- there is a humiliating torment for these people

History repeats itself, so these crimes are being repeated today
- to learn history, we can study fiqhul waaqi

The Rasool (SAW) listened to fiqhul waaqi very keenly
- he sent his Companions to Ethiopia where there was a king
- who does not wrong people
- the king refused Quraish’s gifts and refused to send the Companions back

"…In Habasha, there is a king that no one is wronged under his reign, so emigrate to his country until Allah makes a relief and a way out for you from what you suffer…" [al-Sunan al-Kubra al-Bayhaqi (9/16) No. 17734]

Leaders of communities need to pay attention to fiqhul waaqi
- or they will put the 6 sacred things of the Muslims at stake:

4. AQL

Some people make hijrah and didn't know the fiqhul waaqi ahead of time
- so when they were there, they faced stealing and circumstances they didn't expect
- so they run back home and are discouraged
- they didn't go there for a holiday to see if they can get along with people in the new place,
- not just abruptly move there
- many of you want to make hijrah
- but do you know anything about where you want to make hijrah to?
- do you know the character of the people there?

- he saw many go to other countries and run back home
- because they couldn't find proper masjids to pray in
- because it was 3 hours journey to find a masjid that is on the creed of ASWJ
- they would uproot their wife and children to a new country and put themselves in jeopardy

Fatimah bint Qays went to the Prophet seeking marital advice when both Mu’awiyah Ibin Abu Sufyan and Abu Jahm had proposed to her. The Prophet told her, "Mu’awiyah is stingy and tight fisted) and Abu Jahm beats his women." So marry Usamah instead. [Sahih Muslim (2/1114) No. 1480, Sunan Abu Dawud (2/285) No. 2284, Sunan Tirmidhi (3/440) No. 1134, Sunan An-Nasa'i (6/75) No. 3245]

- this hadeeth tells us that the Prophet knew the minute details,
- even who was stingy or a wife beater in his community
- Fatimah's marriage to Usamah was a success

When someone asks for a character reference about nikah, we're to give honest answers
- this is not backbiting in regard to marriage

A scholar who preaches a false-version of Islam (democracy),
- we're permitted to expose him as well
- Imam Shafi'i said 'that man is a pillar from the pillar of lies'
- so this is permissible to say if someone is a liar or preaching falsehood

If a man wants to open a business with someone who rips off other people in the back,
- we're to be honest and say it
- there is no backbiting with regards to fraudsters

And who does more wrong than the one who invents a lie against Allah, while he is being invited to Islām? And Allah guides not the people who are Zālimûn (polytheists, wrong-doers and disbelievers) folk. (As-Saff 61:7)

A wicked scholar's taubah MUST be made publicly
- Allah said:

Except those who repent and do righteous deeds, and openly declare (the truth which they concealed). These, I will accept their repentance. And I am the One Who accepts repentance, the Most Merciful. (Al-Baqarah 2:160)

When a MADkhali asks you, what if the scholar made taubah?
- We're to say 2:160 says their taubah must be made publicly

Narrated from Anas (RA) that a man said: “O Messenger of Allah, where is my father?” He said: “In Hell.” When he turned away he called him back and said: “My father and your father are in Hell.” [Sahih Muslim (Vol. 1, pg. 191) No. 203]

If someone asks you, 'what if a mushrik can be a Muslim
- if they died before they heard about Islam’
- tell them Muhammad said "my father and your father are in Hellfire"

The grave is an idol

Yahya related to me from Malik from Zayd ibn Aslam from Ata ibn Yasar that the Messenger of Allah (SAW) said, "O Allah! Do not make my grave an idol that is worshipped. The anger on those who took the graves of their Prophets as places of prostration was terrible." [Muwatta Malik (1/223) No. 570, Musannaf Abdur Razzaq (1/406) No. 1587, Musnad Ahmad (2/246) No. 7352]

Umar let the woman go because she was jaahil
- and she committed zina not shirk

On the authority of Qataada who said: “A woman slept with her male servant and cited an ayah of the Holy Qur'an as her evidence for her action. ‘…or the (female) slaves whom their right hands possess…’ (An-Nur 24:31). This woman was brought to Umar ibn al-Khattab (RA) by a group of Sahabas who complained to Umar that she misinterpreted a verse from the Holy Qur’an and slept with her male servant. Umar commanded that the male servant should be sent away for a year and he was beheaded. He then said to the woman you are now haram for all Muslims.” [Tafseer al-Tabari (9/586) No. 11277]

- Allah made takfir on the Jews and Christians
- in surah bayyinah

Those who disbelieve from among the people of the Scripture (Jews and Christians) and among Al-Mushrikûn, were not going to leave (their disbelief) until there came to them clear evidence. (Al-Baiyinah 98:1)

- the one with most excuse is the Rasul (SAW)’s father
- he died when his mother was still pregnant with him, yet he's in hellfire
- you use the aql when you call a mushrik a Muslim
- Shaytan was the first Mu’tazilite

And (remember) when your Lord brought forth from the Children of Adam, from their loins, their seed (or from Adam's loin his offspring) and made them testify as to themselves (saying): "Am I not your Lord?" They said: "Yes! We testify," lest you should say on the Day of Resurrection: "Verily, we have been unaware of this." (Al-A'raf 7:172)

Allah made us testify in 7:172
- you need to know the hujjah to checkmate the munafiq

Allah told us in surah 18:110 that he was just a man
- hence he experienced hunger and cried when his son died
- he tied two stones on his belly when they were digging the trench

Say (O Muhammad SAW): "I am only a man like you. It has been inspired to me that your Ilāh (God) is One Ilāh (God i.e. Allah). So whoever hopes for the Meeting with his Lord, let him work righteousness and associate none as a partner in the worship of his Lord." (Al-Kahf 18:110)

Narrated By Anas bin Malik: We went with Allah's Apostle (p.b.u.h) to the blacksmith Abu Saif, and he was the husband of the wet-nurse of Ibrahim (the son of the Prophet). Allah's Apostle took Ibrahim and kissed him and smelled him and later we entered Abu Saif's house and at that time Ibrahim was in his last breaths, and the eyes of Allah's Apostle (p.b.u.h) started shedding tears. 'Abdur Rahman bin 'Auf said, "O Allah's Apostle, even you are weeping!" He said, "O Ibn 'Auf, this is mercy." Then he wept more and said, "The eyes are shedding tears and the heart is grieved, and we will not say except what pleases our Lord, O Ibrahim ! Indeed we are grieved by your separation." [Sahih Bukhari (2/83) No. 1303]

Abu Talhah (RA) narrated: We complained to Allah’s Messenger (SAW) about our hunger and raising from our stomach (the garment) bared the stone each of us had tied to it. He showed that he had two stones (tied to his stomach.) [Sunan Tirmidhi (4/585) No. 2371, Bayhaqi in ‘Shu'ab al Emaan’ (13/54) No. 9943]

If a Goofy Soofi tells you Allah is not on the Throne
- you need surah 69:17 to checkmate him

And the angels will be on its sides, and eight angels will, that Day, bear the Throne of your Lord above them. (Al-Haqqah 69:17)

Narrated Abu Said: The Prophet said, 'People will be struck unconscious on the Day of Resurrection and I will be the first to regain consciousness, and behold! There I will see Moses holding one of the pillars of Allah's Throne. I will wonder whether he has become conscious before me of he has been exempted, because of his unconsciousness at the Tur (mountain) which he received (on the earth)." [Sahih Bukhari (4/153) No. 3398]
