-404- Hadeeth Number 1 of 40 Hadeeth

All of you have this book in your homes
-but you have not read the sharh
-you just read the isnad and matn
-matn means the body
-isnad means the chain
-so this will be our new series to explain the sharh of imam Nawawi’s 40 hadeeth

So we are taking a break to talk about Usool Thalatha
-imam Nawawi’s books are said to melt the hearts of the Muslims
-they are spiritual


-His name is Abu Zakariyyah Muhiyudeen Yahya ibn Sharaf An Nawawi
-he was born 631 AH which is equivalent to 1238 C.E
-he died 676AH equivalent to 1278 C.E
-this means he belonged to the medieval era
-same era Genghis khan and his children were wreaking havoc
-many other scholars were in this era too

He was of the Shafi’i madhab
-born in Nawa on the outskirts of Damascus
-from the word Nawa we get Nawawi
-from a very tender age he showed love for the deen and knowledge
-and when his father detected this he spent a lot of money for his education
-so if you have 4 sons and one of them love the deen, you send him to an Islamic university
-if the other likes technology you send him to study that etc.
-look for what your children are interested in and send them to study that

In 1253 C.E he went for hajj
-and in Makkah he settled there to teach and acquire additional knowledge,
-he was only 19 years old

He became a famous judge for this ummah
-because he didn’t take bribes and didn’t take sides but with the haqq
-and he was famous for his piety and taqwa so people used to take their cases to him

He is the reformer of the Shafi'i madhab
-so his opinions are the official opinions of the Shafi'i madhab
-just like ibn Taymiyya is for the Hanbali madhab
-e.g. ibn Taymiyya counted 3 sayings of divorce in one sitting as one divorce
-and this is what is taken for the Hanbali madhab

-they used to count it as 3 divorce but later they changed and count it as one divorce
-the reason why you want to speak with the scholars is because
-you don’t want to be in conflict with the local ulama
-and not cause conflict

During his short life he wrote many books but most important are 3 books:

1. Riyadus saliheen

2. The forty hadeeth

3. Sharh Sahih Muslim

4. Kitab al Adhkaar
-this book contains many dua of the prophet (saw)

He died young and was a bachelor


«عن أمير المؤمنين أبي حفص عمر بن الخطاب رضي الله تعالى عنه قال: سمعت رسول الله صلى الله تعالى عليه وعلى آله وسلم يقول: إنما الأعمال بالنيات، وإنما لكل امرئ ما نوى، فمن كانت هجرته إلى الله ورسوله فهجرته إلى الله ورسوله، ومن كانت هجرته لدنيا يصيبها أو امرأة ينكحها فهجرته إلى ما هاجر إليه» .
رواه إماما المحدثين: أبو عبد الله محمد ابن إسماعيل بن إبراهيم بن المغيرة بن بردزبه البخاري، وأبو الحسين مسلم ابن الحجاج بن مسلم القشيري النيسابوري: في صحيحيهما اللذين هما أصح الكتب المصنفة.

On the authority of ameer ul -mumineen (the commander of the faithful), abu hafs Umar ibn al-Khattab (RA), who said: I heard the Messenger of Allah (SAW) say, "Actions are but by intentions and every man shall have only that which he intended. Thus he whose migration (hijrah from Makkah to Madina) was for Allah and His Messenger, his migration was for Allah and His Messenger, and he whose migration was to achieve some worldly benefit or to take some woman in marriage, his migration was for that for which he migrated." It is related by the two imams of the scholars of hadith, Abu Abdullah Muhammad ibn Ismael ibn Ibraheem ibn al-Mugheera ibn Bardizbah al-Bukhari and Abu-l-Husain Muslim ibn al-Hajjaj ibn Muslim al-Qushairee an-Naisaboree, in their two Saheehs, which are the soundest of compiled books [i.e., the most truthful books after the Book of Allah, since the Qur’an is not ‘compiled’].

-this hadith is muttafaqun alaihi
-meaning collected by both Bukhari and Muslim


What is the reason for this statement of the prophet (saw)?
-this is because when he was migrating from Makkah to madina,
-a man migrated to look for a pretty girl in madina
-he joined the bandwagon and found his wife, umm Qays
-so they gave him the nick name muhaajir umm Qays

This hadith tells you intention is important in Islam for our deeds to be accepted
-and for our deeds to be accepted we need 2 things:

-intention needs to be pure
-so do a deed to seek Allah's pleasure not fame and fortune


-so some people are sincere but sincerely wrong
-because the deed they are doing is not in accordance with the Sunnah
-e.g. those people who make tawaaf around the graves
-some are sincere but they are sincerely wrong

This hadith also proves that all acts of ibaadah require intention
-salah, zakah, saum, hajj, jihad etc.
-Allah said:

(Remember) the Day when the Shin shall be laid bare (i.e. the Day of Resurrection) and they shall be called to prostrate (to Allāh), but they (hypocrites) shall not be able to do so, (Al-Qalam 68:42)

Allah said on judgement day He will expose His sheen
-and everyone will bow down on seeing it except the munafiq
-because he used to do deeds to show off in dunya
-hence he won’t be able to bow down

Allah said He is the one who does not need any partners
-so anyone who does a deed associating partners with Him will not have it accepted

The rasool (saw) warned against going for jihad with wrong intentions

On the authority of Abu Hurayrah (RA), who said that the Messenger of Allah (SAW) said: "Allah (glorified and exalted be He) said: 'I am so self-sufficient that I am in no need of having an associate. Thus he who does an action for someone else's sake as well as Mine will have that action renounced by Me to him whom he associated with Me." [Muslim (also by Ibn Majah).]

Narrated By Abu Musa: A man came to the Prophet and asked, "A man fights for war booty; another fights for fame and a third fights for showing off; which of them fights in Allah's Cause?" The Prophet said, "He who fights that Allah's Word (i.e. Islam) should be superior, fights in Allah's Cause." [al-Bukhari (123) and Muslim (1904)]

-the only one fighting for Allah's cause is he who fights to make the kalimah highest
-so practice Ikhlas an niyyah

Allah said:

Say (O Muhammad SAW): "Verily, my Salāt (prayer), my sacrifice, my living, and my dying are for Allāh, the Lord of the 'Alamīn (mankind, jinns and all that exists). (Al-An'am 6:162)

When the rasool said actions are by intentions and every man will get what he intended
-he meant the reward of a noble action depends on the performer's intention for that action
-you may see many people doing salah but may be only a few will get rewarded for it
-because the rest are praying to be seen by men
-Allah said:

Have you seen him who denies the Recompense? (Al-Ma'un 107:1)

That is he who repulses the orphan (harshly), (Al-Ma'un 107:2)

And urges not the feeding of AlMiskīn (the poor), (Al-Ma'un 107:3)

So woe unto those performers of Salāt (prayers) (hypocrites), (Al-Ma'un 107:4)

Who delay their Salāt (prayer) from their stated fixed times, (Al-Ma'un 107:5)

Those who do good deeds only to be seen (of men), (Al-Ma'un 107:6)

And refuse Al-Mā'ûn (small kindnesses e.g. salt, sugar, water, etc.). (Al-Ma'un 107:7)

Narrated By Abu Said: I heard the Prophet saying, "Allah will bring forth the severest Hour, and then all the Believers, men and women, will prostrate themselves before Him, but there will remain those who used to prostrate in the world for showing off and for gaining good reputation. Such people will try to prostrate (on the Day of Judgment) but their back swill be as stiff as if it is one bone (a single vertebra)." [Sahih Bukhari, Vol 6, Book 60, Hadith #441]

This 1st hadith can be misunderstood
-the munafiqoon put a spin on it
-they think that good intention can be used to make haram halal
-e.g. the first winner of the national lottery was a Muslim
-this created a frenzy and many Muslims started to gamble on the lottery
-and if you should see a Muslim doing this and tell him it is haram,
-he will tell you his intention is pure
-because when he wins he will spend on the mujahideen
-and the prophet said actions are by intentions
-so beware!!

When you study usoolul fiqh they will tell you anything that leads to haram is haram
-and good intentions do not justify doing haram
-they try to put a spin on halal and haram
-therefore good intentions cannot be used to make halal, haram

Umar ibn al-Khattab (RA) said: "The best acts are doing what Allah has commanded, staying far away from what Allah has forbidden, and having sincere intentions towards what-ever Allah has required of us." [Ihya Uloom al-Deen, al-Ghazali (4/364) and Jama' ul-Uloom al-Hukum, Ibn Rajab (2/336)]

Many small actions are made great because of good intentions behind them
-and many great actions were rendered null because of bad intentions behind them

On the authority of Abu Huraira, I heard the Messenger of Allah (SAW) say: The first of men (whose case) will be decided on the Day of Judgment will be a man who died as a martyr. He shall be brought (before the Judgment Seat). Allah will make him recount His blessings (i.e. the blessings which He had bestowed upon him) and he will recount them (and admit having enjoyed them in his life). (Then) will Allah say: What did you do (to requite these blessings)? He will say: I fought for Thee until I died as a martyr. Allah will say: You have told a lie. You fought that you might be called a "brave warrior". And you were called so, (Then) orders will be passed against him and he will be dragged with his face downward and cast into Hell. Then will be brought forward a man who acquired knowledge and imparted it (to others) and recited the Qur'an. He will be brought And Allah will make him recount His blessings and he will recount them (and admit having enjoyed them in his lifetime). Then will Allah ask: What did you do (to requite these blessings)? He will say: I acquired knowledge and disseminated it and recited the Qur'an seeking Thy pleasure. Allah will say: You have told a lie. You acquired knowledge so that you might be called "a scholar," and you recited the Qur'an so that it might be said: "He is a Qari" and such has been said. Then orders will be passed against him and he shall be dragged with his face downward and cast into the Fire. Then will be brought a man whom Allah had made abundantly rich and had granted every kind of wealth. He will be brought and Allah will make him recount His blessings and he will recount them and (admit having enjoyed them in his lifetime). Allah will (then) ask: What have you done (to requite these blessings)? He will say: I spent money in every cause in which Thou wished that it should be spent. Allah will say: You are lying. You did (so) that it might be said about (You): "He is a generous fellow" and so it was said. Then will Allah pass orders and he will be dragged with his face downward and thrown into Hell. [Sahih Muslim 4688, Tirmidhi 2382]

This 1st hadith of An Nawawi is aahad
-the prophet said it to only one man so only one man transmitted it
-this was Umar ibn Al Khattab (r.a)
-yet the ummah received the hadith and put it into their aqeeda

So who told you, you can’t put aahad hadith into your aqeeda?
-this is the aqeeda of the Mu’tazilite

The opposite of aahad is mutawaatir
-meaning many sahabah heard it from the prophet (saw)

The prophet (saw) sent one man to teach the people of Yemen their religion
-but they did not tell him you are just one man so we can’t take what you are teaching
-so are you saying the prophet did a disservice to the people of Yemen?
-your usoolul fiqh does not stand to scrutiny

Good intentions belong to the heart
-therefore it is a bid'ah to voice it out
-the only intentions you are allowed to pronounce are hajj and umrah
-labaika umrah or labaika hajj

Ka’b ibn Malik (RA) reported that he heard Allah’s Messenger (SAW) say: “If anyone seeks knowledge in order to compete with the scholars or to concur with the foolish or to direct the faces of the people toward himself, Allah will put him in the fire." [Sunan Tirmidhi (5/32) No. 2654, Sunan Darimi (1/374) No. 379, Sunan Ibn Majah (1/170) No. 254, Mustadrak al-Haakim (1/161) No. 293, Sahih Ibn Hibban (1/278) No. 77, Shu’ab al-Iman al-Bayhaqi (3/269) No. 1636, al-Mu’jam al-Awsat al-Tabarani (6/32) No. 5708]

The Jews used to seek knowledge to show off
-and used to ask the prophet difficult questions
-the prophet said beware of the shirk of riyaa

Abu Musa al-Ash’ari (RA) reported that Allah’s Messenger (SAW) said: "O people, save yourselves from this shirk (ash-Shirk al-Khafi) for it is more inconspicuous than the creeping of ant." So someone, whom Allah willed to say, said: 'How do we save ourselves from it while it is more inconspicuous than the creeping of ant ya Rasool Allah?' Prophet (SAW) said: “Say: اللَّهُمَّ إِنَّا نَعُوذُ بِكَ مِنْ أَنْ نُشْرِكَ بِكَ شَيْئًا نَعْلَمُهُ، وَنَسْتَغْفِرُكَ لِمَا لَا نَعْلَم
Allahumma inni audhubika minal nushrika bika shayaan na'alamuhu, wa nastaghfiruka lima la na'alam (O Allah we take Your refuge from doing shirk with You knowingly, and ask for Your forgiveness for doing it unknowingly)" [Musnad Ahmed (4/403) No. 19622 and Musannaf Ibn Abi Shaibah (6/70) No. 29547]

The ibaadah of a mad man is void because intention is required for an action
-and he cannot make his intentions
-so when you study fiqh they will tell you the conditions for the acts of ibaadah
-and one of them is sanity
-e.g. if a child makes hajj before puberty, the barakah goes to his parents
-so he has to make another hajj when he reaches puberty

ACTIONS ARE BY INTENTIONS mean the ibaadah of a kaafir is not accepted
-how can he stand up to pray when in his heart is 'Jesus is god'?
-Allah said:

"Verily, Allāh accepts only from those who are Al-Muttaqûn (the pious - see V.2:2)." (Al-Ma'idah 5:27)

Concerning the niyyah, it is possible for the intention of the imam
-to be different from the musalleen
-he may be asked to lead asr but he has not prayed dhuhr yet
-he is allowed to lead the salah with the intention of dhuhr while he leads them for asr
-this is Hanbali fiqh but the Hanafis disagree
-the evidence for this is that a sahabi used to do it

This 1st hadith is alluding to the fact that hijra is important for various reasons
-and hijra to madina with the prophet was a great act of ibaadah
-you were at a great seat of learning with the prophet (saw)
-and it is the first Islamic state on earth
-those companions who migrated with him became scholars,
-fuqahaa, zahidoon, mujahidoon and shuhada

Jabir (RA) narrated the Messenger of Allah (SAW) said: "The master of the martyrs is Hamza ibn Abdul Mattalib, and a man who stands (in front of) an oppressive ruler and enjoins the good and forbids the evil and so is killed for it." [Mustadrak al-Haakim (3/215) No. 4884]

Narrated By Ibn 'Abbas: Once the Prophet embraced me and said, "O Allah! Bestow on him the knowledge of the Book (Qur'an)." [Sahih Bukhari, Vol 1, Book 3, Hadith #075]

They drank directly from the fountain of knowledge
-they were hearing it directly from the source

Some sahabah did not migrate because their wives told them not to
-later they migrated and when they caught up with the sahabah they became very angry
-because they stayed behind and now are very jaahil
-they wanted to beat up their wives
-because they stopped them from migrating and made them jaahil
-Allah revealed an ayah as a result

O you who believe! Verily, among your wives and your children there are enemies for you (i.e. may stop you from the obedience of Allāh), therefore beware of them! But if you pardon (them) and overlook, and forgive (their faults), then verily, Allāh is Oft-Forgiving, Most Merciful. (At-Taghabun 64:14)

When Umar was the caliph he didn’t allow the great sahabah to leave madina
-because he did not want to make mistakes while implementing the Shari’ah
-'what if when implementing the Shari’ah, I forget something?'
-especially using Ali r.a

This hadith is clear evidence that not every Muslim who jumps on the bandwagon is sincere
-it is possible for a man to hide behind religion for worldly benefits
-the sahabi migrated for a woman because Madina had pretty women
-and they also had a strong personality

Ibn Abu Umar (RA) reported from Sufyan from Ibn Munkadir that he heard Jabir (RA) say, “The Jews used to say that if anyone has sex with his wife from the front but comes from the rear then their child will be squint eyed. So this verse was revealed; “Your wives are as a tilth unto you; so approach your tilth when or how ye will.” (2: 223) [Tirmidhi 2989, Bukhari 21528, Muslim 1435, Abu Dawud 2163, Nisai 2163, Muslim 11038, Ibn e Majah 1925]

Your wives are a tilth for you, so go to your tilth (have sexual relations with your wives in any manner as long as it is in the vagina and not in the anus), when or how you will, and send (good deeds, or ask Allāh to bestow upon you pious offspring) before you for your ownselves. And fear Allāh, and know that you are to meet Him (in the Hereafter), and give good tidings to the believers (O Muhammad ). (Al-Baqarah 2:223)

This hadith is hujjah for the importance of ilm
-Abu Huraira migrated penniless to be in the company of the prophet (saw)
-because of his love for knowledge
-Allah said:

And when you are told to rise up [for prayers, Jihād (holy fighting in Allāh's Cause), or for any other good deed], rise up. Allāh will exalt in degree those of you who believe, and those who have been granted knowledge. And Allāh is Well-Acquainted with what you do. (Al-Mujadilah 58:11)

Is one who is obedient to Allāh, prostrating himself or standing (in prayer) during the hours of the night, fearing the Hereafter and hoping for the Mercy of his Lord (like one who disbelieves)? Say: "Are those who know equal to those who know not?" It is only men of understanding who will remember (i.e. get a lesson from Allāh's Signs and Verses). (Az-Zumar 39:9)

"All in the heavens and earth and the fish in the depth of the water seek forgiveness for the scholar, and the superiority of the scholar over the worshipper is like the superiority of the full moon at night over the rest of the stars. Verily the scholars are the heirs to the Prophets. Verily, the Prophets did not bequeath deenars or dirhams. All they left behind was knowledge, so whoever takes it, has indeed acquired a huge fortune." [Musnad Ahmad (5/196) No. 21763; Also related by Abu Dawud (2/341) No. 3641; at-Tirmidhi (5/48) No. 2682; Ibn Majah (1/150) No. 223, ad-Daarimee (1/110) No. 342 and ibn Hibbaan (1/289) No. 88]

Narrated By Muawiya: I heard Allah's Apostle saying, "If Allah wants to do good to a person, He makes him comprehend the religion. I am just a distributor, but the grant is from Allah. (And remember) that this nation (true Muslims) will keep on following Allah's teachings strictly and they will not be harmed by any one going on a different path till Allah's order (Day of Judgment) is established." [Sahih Bukhari, Vol 1, Book 3, Hadith #071]

Abu Umamah Bahili (RA) reported that Allah’s Messenger (SAW) said: “Surely, Allah, His angels, the inhabitants of the heavens and the earths, even the ants in their holes and even the fish invoke blessings on the teacher of the people about what is good.” [Sunan Tirmidhi (5/50) No. 2685]

Abu Huraira (RA) reported that Allah’s Messenger (SAW) said, “The words of wisdom are the lost possession of a believer. So, where so ever he finds them, he has more right over them.” [Sunan Tirmidhi (5/51) No. 2687, Ibn Majah (5/269) No. 4169]

Hadeeth on knowledge:

Abu Huraira (RA) reported that Allah's Messenger (SAW) said, “The world, with all that it contains, is accursed except for dhikr (the remembrance of Allah) that which pleases Allah; and the religious scholars and seekers of knowledge.'' [Sunan Tirmidhi (4/561) 2322 and Sunan Ibn Majah (5/231) 4112, (Abu Eesa al-Tirmidhi said: this hadeeth is hasan ghareeb)]

“Whoever seeks knowledge that should be sought seeking the Face of Allah, but he only seeks it for the sake of some worldly gain, he will not smell the fragrance of Paradise on the Day of Resurrection." (Hasan) [The Book of Knowledge: Sunan Abu Dawud]

Al-Ash'ari said, "Part of respect for Allah is to show respect to an old Muslim and to someone who knows the Qur'an, as long as he does not go to excess in it nor turn away from it, and to respect a just ruler." [Al-Adab al-Mufrad Al-Bukhari, Hadith #357]

Abu Hurayrah relates that the Prophet said, "For him who embarks on the path of seeking knowledge, Allah will ease for him the way to paradise." (Related by Muslim)

This hadith we are explaining alludes to the importance of making hijrah
-to escape tyranny and oppression of the kuffaar
-because the Muslims were suffering at the hands of the kuffaar of Quraish
-and Allah said:

And they will never cease fighting you until they turn you back from your religion (Islāmic Monotheism) if they can. And whosoever of you turns back from his religion and dies as a disbeliever, then his deeds will be lost in this life and in the Hereafter, and they will be the dwellers of the Fire. They will abide therein forever." (Al-Baqarah 2:217)

-so Allah is telling you even the homosexuals have no tolerance
-to taqwa in their environment

And the answer of his people was only that they said: "Drive them out of your town, these are indeed men who want to be pure (from sins)!" (Al-A'raf 7:82)

-there are 3 daars:

1. Darul kufr

2. Darul harb

3. Darul Islam

Therefore there are 3 types of hijrah

1. To migrate from darul harb to darul kufr
-e.g. when the sahabah migrated from Makkah to Ethiopia
-Abyssinia was a Christian country

2. To migrate from darul harb to darul Islam
-e.g. migration from Makkah to madina

3. To migrate from darul kufr to darul Islam
-e.g. to migrate from Ethiopia to madina

As for the hadith:"

Narrated by Ibn 'Abbas: Allah's Apostle said, "There is no Hijra (i.e. migration) (from Mecca to Medina) after the Conquest (of Mecca), but Jihad and good intention remain; and if you are called (by the Muslim ruler) for fighting, go forth immediately. [Sahih Bukhari, Vol 4, Book 52, Hadith #042]

-it means there is no more need to leave Makkah for madina
-because it is no longer darul harb
-Makkah has now become darul Islam


The rasool (saw) said:

On the authority of Jarir bin 'Abdullah that the Messenger of Allah (SAW) sent a military expedition to Khath'am. So some people (living there) sought safety by prostrating, but they were met quickly and killed. News of this reached the Prophet (SAW) upon which he commanded that they be given half of the 'Aql (blood money). And he said: "I am free from every Muslim that lives among the idolaters." They said: "O Messenger of Allah: How is that?" He said: "They should not see each other's campfires." [Sunan Tirmidhi (4/155) No. 1604 and Sunan Abu Dawud (3/45) No. 2645]

-this hadith is talking about darul harb
-where your life and property is threatened

It was narrated from Samurah that the Prophet (SAW) said: “Do not live among the mushrikeen and do not mix with them, for whoever lives among them or mixes with them is not one of us.” [al-Sunan al-Kubra al-Bayhaqi (9/240) No. 18420 and Mustadrak al-Haakim (2/154) No. 2627. adh-Dhahabi graded this on the conditions of Bukhari and Muslim]

It was narrated by Mu'awiya that he heard the Prophet (SAW) said: “Hijrah will not be terminate until Tawbah is terminated, and Tawbah will not be terminated until sun rises from the west” [al-Tareekh al-Kabeer al-Bukhari (9/80) No. 770, Abu Dawud (3/3) No. 2479, Sunan al-Darime (2/312) No. 2513, Musnad Ahmad (4/99) No. 16952, al-Sunan al-Kubra al-Nasa'i (8/67) No. 8658]

Ibn al-Arabi (rh) said, “It is obligatory to leave a place where forbidden practices are rife since it is mandatory for Muslims to demand observance of the Law.” [Ibn al-Arabi, Ahkaam al-Qur’an (1/484-485)]

Shaykh ul Islam Ibn Taymiyyah (rh) said, “The state of a place reflects the state of a person. It is possible to be sometimes a Muslim and at other times a disbeliever; sometimes sincere and at other times hypocritical; sometimes good and pious and at other times rotten and corrupt. Thus, a person becomes like the place of his abode. The migration of a person from a land of disbelief and profanity to one of faith and probity is an expression of repentance and of his turning away from disobedience and perversion to belief and obedience. This is so until the Day of Resurrection.” [Majmu’al-Fatawa, (18/284)]

Some live in darul harb and become rotten
-ibn Taymiyya said hijrah from an evil place is fard till judgement day


Abu Sa'id al-Khudri reported Allah's Messenger (SAW) as saying: There was a person before you who had killed ninety-nine persons and then made an inquiry about the learned persons of the world (who could show him the way to salvation). He was directed to a monk. He came to him and told him that he had killed ninety-nine persons and asked him whether there was any scope for his repentance to be accepted. He said: No. He killed him also and thus completed one hundred. He then asked about the learned persons of the earth and he was directed to a scholar, and he told him that he had killed one hundred persons and asked him whether there was any scope for his repentance to be accepted. He said: Yes; what stands between you and the repentance? You better go to such and such land; there are people devoted to prayer and worship and you also worship along with them and do not come to the land of yours since it was an evil land (for you). So he went away and he had hardly covered half the distance when death came to him and there was a dispute between the angels of mercy and the angels of punishment. The angels of mercy said: This man has come as a penitent and remorseful to Allah and the angels of punishment said: He has done no good at all. Then there came another angel in the form of a human being in order to decide between them. He said: You measure the land to which he has drawn near. They measured it and found him nearer to the land where he intended to go (the land of piety), and so the angels of mercy took possession of it. Qatada said that Hasan told him that it was said to them that as death approached him, he crawled upon his chest (and managed) to slip in the land of mercy. [Sahih Muslim, Book 37, Hadith #6662]

Ibn Hazm (rh) states that: “Whoever joins the ‘land of war’ and disbelief, of his own free will and in defiance of whoever amongst the Muslims calls him to his side, is by virtue of this act an apostate, by all the laws of apostasy, in Islam. Whoever is able to kill him must do so. His property is unprotected, his marriage null and void, all his rights are swept away. But whoever flees to the ‘land of war’ for fear of oppression, who neither opposes the Muslims in anything nor bears any malice towards them, and who was not able to find any refuge among the Muslims, is free of any guilt since he was compelled to leave. As for someone who takes the Muslims as his enemies, offering his help and his service to the disbelievers, he is a disbeliever. But those who would emigrate to non-Muslim lands in search of wealth or prosperity to live under their protection, while they were able to go to live amongst the Muslims in their own land, but still do not withdraw themselves from the disbelievers; such people are not far from the fold of disbelief, and we can find no possible excuse for them, so we ask Allah’s Forgiveness. As for the person who lives in the land of Karmathians by his own free will, he is without doubt a disbeliever, because they are avowed enemies of Islam, disbelievers and apostates who only long for the destruction of the Muslims. Concerning those who live in a land where some heretic tendencies, leading to disbelief, are manifested, they are not considered disbelievers, as Islam is supreme in the land where it is possible to practice Islam openly; to confirm the message of the Prophet Muhammad (SAW), read the Qur’an, establish the prayer, perform the fast of Ramadan and fulfill one’s obligations entirely. The words of the Prophet (SAW), “I am not responsible for any Muslim who stays among polytheists” should clarify what we have said so far. It is clear that the Prophet (SAW) refers here to the ‘Dar ul-Harb’, and because he (SAW) appointed some Companions as governors of Khaibar (Jewish land), even though everyone who lived there were Jews. If a disbeliever conquers a Muslim country, then acknowledges their religion (Islam), but assumes authority over them, and then claims any other religion than Islam, whoever lives with him, supports, or serves him in any way is a disbeliever, even if he claims to be a Muslim, as aforementioned.” [Ibn Hazm, al-Muhalla’: (13/139-140)]

They (the Companions) said: Messenger of Allah is there reward for him who satisfies his sexual passion among us? He said: Tell me, if he were to devote it to something forbidden, would it not be a sin on his part? Similarly, if he were to devote it to something lawful, he should have a reward.
