SHARH OF THE 40 HADEETH OF IMAM AN NAWAWI: HADEETH NUMBER 11

HADITH NUMBER 11:

الحديث الحادي عشر
«عن أبي محمد الحسن بن علي بن أبي طالب سبط رسول الله صلى الله عليه وآله وسلم وريحانته رضي الله عنهما قال: حفظت من رسول الله صلى الله عليه وآله وسلم دع ما يريبك إلى ما لا يريبك» .
رواه الترمذي والنسائي، وقال الترمذي: حديث حسن صحيح.

On the authority of Abu Muhammad al-Hasan ibn Ali ibn Abee Talib (RA), the grandson of the Messenger of Allah (SAW), and the one much loved by him, who said: I memorised from the Messenger of Allah (SAW): "Leave that which makes you doubt for that which does not make you doubt." It was related by at-Tirmidhi and an-Nasai, with at-Tirmidhi saying that it was a good and sound (hasan saheeh) hadith.


WHO WAS HASAN IBN ABI TALIB (r.a)

Hasan was the grandson of the rasul (saw)
-he was born three years after the hijra
-and died 50 years after the hijra aged 47
-he was caliph for 6 months
-the rasul (saw) prophesised that he'll bring peace
-to two warring factions of the ummah
-and what he did was praised by the rasul
-and no one should criticise his decision

Narrated Abu Bakra: I heard the Prophet talking at the pulpit while Al-Hasan was sitting beside him, and he (i.e. the Prophet ) was once looking at the people and at another time Al-Hasan, and saying, "This son of mine is a Saiyid (i.e. chief) and perhaps Allah will bring about an agreement between two sects of the Muslims through him." [Sahih Bukhari (5/26) No. 3746]

During the caliphate of Ali (r.a) Mu’awiya refused to give bay'a to him
-Ali fought him and Hassan was fiercely by his father's side
-Ali was killed by the Khawarij for revenge against him

Hassan took over after his father
-and is listed as the 5th rightly guided caliph
-he gave the caliphate to Mu’awiya
-on condition that he'll give the caliphate back to him not his son
-the Muslims were against the fact that he gave the caliphate to Yazid

Mu’awiya was a scholar but he didn't expand on his knowledge
-after he became the caliph
-he concentrated on conquering territories
-he surrounded himself with scholars who advised him on how to implement the sharia

Abu Sa’eed (RA) reported that Allah’s Messenger (SAW) said, “Hasan and Husayn are the chief of the youth of paradise.” [Musnad Ahmad (3/3) No. 11012, Sunan Tirmidhi (5/656) No. 3768, Mustadrak al-Haakim (3/182) No. 4778]

Hassan died in Madina aged 47


SHARH OF HADITH

On many occasions, Allah (swt) spoke about doubt (dhan, shubuhaat)
-the Christians make it their creed that Jesus (a.s) was crucified based on dhan
-they can't make it yaqeen (certainty)

And because of their saying (in boast), "We killed Messiah 'Iesa (Jesus), son of Maryam (Mary), the Messenger of Allāh," - but they killed him not, nor crucified him, but the resemblance of 'Iesa (Jesus) was put over another man (and they killed that man), and those who differ therein are full of doubts. They have no (certain) knowledge, they follow nothing but conjecture. For surely; they killed him not [i.e. 'Iesa (Jesus), son of Maryam (Mary) ]: (An-Nisa 4:157)

-Allah is talking about the sahabah in 33:10 that they entertained dhan about Allah
-when the Jews stabbed them in the back

When they came upon you from above you and from below you, and when the eyes grew wild and the hearts reached to the throats, and you were harbouring doubts about Allāh. (Al-Ahzab 33:10)

-Allah referred to dhan as suspicion in 49:12

O you who believe! Avoid much suspicions, indeed some suspicions are sins. And spy not, neither backbite one another. Would one of you like to eat the flesh of his dead brother? You would hate it (so hate backbiting). And fear Allāh. Verily, Allāh is the One Who accepts repentance, Most Merciful. (Al-Hujurat 49:12)

And that He may punish the Munāfiqûn (hypocrites), men and women, and also the Mushrikûn men and women, who think evil thoughts about Allāh, for them is a disgraceful torment, and the Anger of Allāh is upon them, and He has cursed them and prepared Hell for them, and worst indeed is that destination. (Al-Fath 48:6)

-dhan that has no basis is a sin
-sometimes you have guest and you lose something (say a mobile)
-and you accuse the poorest among them
-this type of dhan is haram
-this is the dhan Allah is talking about in surah 49:12


TYPES OF DHANN

1. TO DOUBT YOUR DEEN

You aren't sure the Quran is a book of Allah
-you doubt the rasul (saw)
-you doubt the existence of paradise and hell
-if you have doubt that means your shahada is nullified
-because one of its pillars is certainty (yaqeen)

The scholars of Islam describe the one who doubts
-as worse than the faasiq
-because he (the faasiq) doesn't doubt his faith, he's just sinful
-but he who doesn't commit sins but doubt his faith is a kaafir

Narrated 'Aishah: that the Messenger of Allah (SAW): "Avert the legal penalties from the Muslims as much as possible, if he has a way out then leave him to his way, for if the Imam makes a mistake in forgiving it would be better than making mistake in punishment." [Sunan Tirmidhi (4/33) No. 1424]

-sometimes we doubt the status of a man (Muslim or kaafir)
-if you have proposals for your daughter
-one you are sure is a muslim and the other you are not
-marry your daughter to the one you are sure is a Muslim
-this is the advice of the rasul (saw)
-the one you doubt maybe a spy
-we are living in the last days
-you can't be too careful even if they call you paranoid

Before the Hour comes, there will be a tribulation like patches of dark night. A man will get up a believer and go to sleep a kaafir, or will go to sleep a believer and get up a kaafir. (Abu Dawud.)

-Anwar Al Awlaki (r.a) was a victim of this

-when you doubt a man use an alim who has firaasa to check him out

Abu Sa’eed Khudri (RA) reported that Allah’s Messenger (SAW) said, ‘Guard yourself against a Believer’s insight, for, he sees with the light of Allah.” He then recited: Surely in that are signs for the sagacious. (15:75) [Sunan Tirmidhi (Vol. 5, pg. 298) No. 3127]

Anas Ibn Malik narrated the Messenger of Allah (SAW) said: "A believer is shrewd, sharp and careful." [Quda'ee (d. 454 H) in 'Musnad al-Shihab' (Vol. 1 pg. 107) No. 128]

-you should not allow to be bitten in the same hole twice

Abu Huraira (RA) narrated the Prophet (SAW) said: "A believer is not bitten from the same hole twice.” [Related by al-Bukhari (6133) and Muslim (2998)]

-a believer is not naive
-when you have taqwa Allah will give you furqan

O you who believe! If you obey and fear Allāh, He will grant you Furqān a criterion [(to judge between right and wrong), or (Makhraj, i.e. making a way for you to get out from every difficulty)], and will expiate for you your sins, and forgive you, and Allāh is the Owner of the Great Bounty. (Al-Anfal 8:29)

2. DOUBT ABOUT WHETHER THE MEAT IS HALAL OR HARAM

If the meat is doubtful then do not eat it
-if the butcher is a Shia, Berailvis or goofi soofi, the meat is doubtful
-only buy from the butchers who are upright

SHIA HUJJAH: The present Quran is in an altered, corrupted and distorted form.. (Fatuhat-e-Shia, p. 129)

SHIA HUJJAH: “Allah often lies and does mistakes” [Usool-al-Kafi, page 328, Yacoob Kulayni, Vol. 1]

3. DOUBTFUL MARRIAGE

If a woman has doubt whether her marriage is baatil or not
-in this case she needs to take the matter to an alim
-who will vet the husband’s character and give the rubber stamp

Hanbali fiqh states that if a man sleeps with a woman before marrying her
-then the marriage is baatil
-so you need an alim to sort it for you

4. DOUBT ABOUT A MISSING PERSON

There are many sisters in the UK and USA whose husbands went for jihad
-they do not have any news about them
-they should not remarry until there is confirmed news about whether they dead or alive
-if she remarries and the old husband returns
-she'll have the choice to go with either of the two

5. DOUBT ABOUT WATER BEING PURE

You can't doubt until you see impure particles

6. DOUBT ABOUT WUDU

If you have doubt that your wudu is broken then you still have wudu
-wudu is broken when you pass wind,
-sleep lying down (to sleep sitting does not break wudu)
-doubt is never hujjah against certainty

And most of them follow nothing but conjecture. Certainly, conjecture can be of no avail against the truth. Surely, Allah is All-Aware of what they do. (Yunus 10:36)


7. DOUBT ABOUT MENSURAL CYCLE

If a Muslim woman has doubt whether her menses is on or not
-every Muslim woman should know when and for how long she menstruates
-menstruation stops you from salah, fasting and to go to bed with your husband

If your cycle is 5 days and the blood stops after 2 days you are still not pure
-because your cycle is not finished
-you need to be patient until you see the white discharge (clear discharge)

8. DOUBT ABOUT HOW MANY RA'KA YOU PRAYED

If you are a man pray in jamm’ah
-because the shaytan plays mind game with you
-and you do not have khushu in your salah

9. DOUBT WHETHER YOU BROKE WIND IN SALAH

If you are in salah and doubt that you passed wind
-you should not leave the salah to make wudu until you hear a sound or smell it

"One should not leave his prayer until he hears a sound or finds a smell" [Reported by Imams al-Bukhari and Muslim ]

10. DOUBT ABOUT THE INNOCENCE OF A MAN

According to sharia law every man is innocent until proven guilty
-you should only punish a man when you are absolutely sure that he is guilty
-some scholars say that this was a statement of Umar (r.a) rather than a hadith

ضعيف حديث ادرؤوا الحدود بالشبهات ... من حديث عائشة أخرجه الترمذي برقم : 1424 , والحاكم ( 4 / 384 ) والبيهقي ( 8 / 338 ) وفيه يزيد بن زياد الشامي وفيه ضعف وقد جاء من حديث أبي هريرة : أخرجه ابن ماجة برقم : 2545 وفيه إبراهيم بن الفضل المخزومي متروك . وجاء موقوفا عن عمر : أخرجه ابن أبي شيبة ( 9 / 566 ) وصحح اسناده الحافظ في التلخيص ( 4 / 56 ) وكذا قال السخاوي

11. DOUBT ABOUT THE PERMISSIBILITY OF A PARTICULAR THING

If you have doubt whether a thing is haram then it is halal
-according to sharia law everything is halal until it is haram
-if you have no evidence to prove it haram then it is halal

...Allah intends for you ease, and He does not want to make things difficult for you.... (Al-Baqarah 2:185)

...Certainly, conjecture can be of no avail against the truth. Surely, Allah is All-Aware of what they do. (Yunus 10:36)


ISTISHAAB- to presume the continuity of a fact till proven otherwise

1. EVERYMAN IS INNOCENT UNTIL PROVEN GULTY

2. EVERYTHING IS HALAL UNTIL PROVEN HARAM

Why do the scholars say that everything in the bedroom is halal except anal sex?

Abu Huraira (RA) narrated that the Prophet (SAW) said, "If anyone has sexual intercourse with a menstruating woman, or goes into her anus, or visits a Kahin (soothsayer) then indeed he has disbelieved in what is revealed to Muhammad." [narrated by Ahmad (Vol. 2, pg.408) No. 9279; Abu Dawood (Vol. 2, pg.408) No. 3904; Tirmidhi (Vol. 1, pg.242) No.135; Ibn Maajah (Vol. 1, pg.404) No. 639]

3. A MARRIAGE IS INTACT UNTIL TALAQ, FASKH, OR KHULA TAKES PLACE

The scholars annul the marriage (faskh) when your husband is a wife beater
-or an apostate

4. THE WATER REMAINS PURE UNTIL YOU SEE IMPURITY IN IT

5. AN ACT REMAINS PROHIBITTED UNTIL THE AMIR MAKES A PUBLIC DECLARATION THAT IT IS NO LONGER PROHITTED

6. A MISSING MAN REMAINS ALIVE UNTIL WE HAVE PROVE THAT HE IS DEAD BECAUSE DOUBT CAN'T BE USED TO PRONOUNCE HIM DEAD

An-Nu'man ibn Bashir said, "I heard the Messenger of Allah (SAW), say, 'The halal is clear and the haram is clear. But between the two there are doubtful things about which most people have no knowledge. Whoever exercises caution with regard to what is doubtful, shows prudence in respect of his deen and his honour. Whoever gets involved in the doubtful things is like a herdsman who grazes his animals near a private preserve (hima). He is bound to enter it. Every king has a private preserve and the private preserve of Allah on His earth are the things that He has made forbidden. There is a lump of flesh in the body, the nature of which is that when it is sound, the entire body is sound, and when it is corrupt, the entire body is corrupt - it is the heart.'" [al-Bukhari (52) and Muslim (1599)]

Imam Ahmad (bin Hanbal) said that "The principles of Islam are based on three hadith: the hadith of 'Umar that "deeds are judged only by intention," the hadith of 'A'isha, "Whoever introduces into our affairs that which does not belong, it is rejected," and the hadith of al-Nu'man b. Bashir, "The licit is clear and the illicit is clear." [Jama' ul-Uloom al-Hukum, Ibn Rajab (1/61)]




QUESTION 1:-

Is it haram for a Muslim man to sell lady’s products like wigs, makeup and such to non-muslim women? And as far as the cycle is concerned, how can she not be pure, sometimes after breastfeeding or having a child this can cause the cycle to change to a different number of days

ANSWER 2:-
-when you are in darul harb you can sell the kuffar anything
-because when they die they belong to the hell fire
-the information given about the cycle means under normal circumstances



QUESTION 2:-

Assalamu alaikum shaikh, you have spoken about what a man should do if he always has doubts with regards to how many rak’ah he did (i.e. pray in jama'ah). What should a woman do because they always pray at home? JazakAllah Khair

ANSWER 3:-
-women should do the same as men
-the women can pray in jamm’ah
-they can call adhan when no men are around according to Hanafi fiqh
-pray in jamm’ah at all times if able
-two people is enough but better to have at least three

Ibn Qudaamah said: it is Sunnah, when a woman to lead other women in prayer, for her to stand in the middle of the row in all cases, because they are ‘awrah. [Al-Mughni, vol. 1, p. 347]

Al-Nawawi said: The Sunnah is for a woman who is leading other women in prayer to stand in the middle of the row, because of the reports which state that ‘Aa’ishah and Umm Salamah led other women and they stood in the midst of them. [Al-Majmoo’ Sharh al-Muhadhdab, vol. 4, p. 192]

On the authority of Umm al-Hasan that she saw Umm Salamah, the wife of the Prophet (SAW) leading the women in prayer. She stood with them in the same row. [Musannaf Ibn Abi Shaybah (1/430) No. 4953]

On the authority of Ra'itha al-Hanafi that A’isha (RA) led women in praying the obligatory prayer. She led them standing in their midst. [al-Sunan al-Kabir al-Bayhaqi (3/187) No. 5355]



QUESTION 4:-

Assalamu alaikum, Can you tell me the ruling on meat that is made in America? Their treatment of the animals is terrible, so it is doubtful. jzk

ANSWER 4:-
-if Christians slaughtered and don't say anything the meat is halal
-you can buy kosher meat in your area
-you don't have to travel far distances to get halal meat
-when you can buy kosher meat near you

...The food (slaughtered cattle, eatable animals, etc.) of the people of the Scripture (Jews and Christians) is lawful to you and yours is lawful to them... (Al-Ma'idah 5:5)

-do not burden yourself. Allah has made the meat of Jews and Christians halal for you

We have not sent down the Qur'an unto you (O Muhammad SAW) to cause you distress, (Ta-Ha 20:2)



QUESTION 5:-

Assalamu alaikum, I am a mini cab driver and work night shifts. Can I apply the same rule of joining the prayers as I find it very difficult to offer my prayers at the prescribed times?

-because you travel constantly you can combine your prayers
