الحديث الثانى والعشرون
«عن أبي عبد الله جابر بن عبد الله الأنصاري رضي الله عنهما أن رجلا سأل رسول الله صلى الله عليه وآله وسلم فقال: أرأيت إذا صليت المكتوبات، وصمت رمضان، وأحللت الحلال، وحرمت الحرام، ولم أزد على ذلك شيئا، أدخل الجنة؟ قال نعم» .
On the authority of Abu Abdullah Jabir bin Abdullah al-Ansaree (RA) that: A man questioned the Messenger of Allah (SAW) and said, "Do you think that if I perform the obligatory prayers, fast in Ramadhan, treat as lawful that which is halal, and treat as forbidden that which is haram, and do not increase upon that [in voluntary good deeds], then I shall enter Paradise?" He (SAW) replied, "Yes." It was related by Muslim.
BIOGRAPHY OF JABIR IBN ABDULLAH:
He was a famous sahabi of the prophet (saw)
-he was born in Madina 15 years before hijrah
-and was from the Khazraj tribe
-the scholars who say he participated in the battle of badr,
-their version of events is more accurate
-not only did he fight in Badr he also fought in 19 battles alongside the prophet
In the battle of badr,
-his father restricted him to giving water to the mujahideen
-he had 7 sisters: his father wanted him to be alive in case
-something happened to him (so that he can look after his sisters)
At the battle of Uhud, the father of Jabir got killed accidentally
-he was a staunch supporter of Ali
-and he took sides with Ali against Mu’awiya
-Because of this he is loved by the Shi'ites
Not only did he participate in the battle of Siffin
-he fought in the battle of nahruwan also
-both battles were fought in Iraq
He had a long life, died 78 years after hijrah at the age of 94
-his grave is in Iraq
Jabir complained that his camel was old
-the prophet (saw) slapped his old and lean camel which then became healthy and young
-the camel was able to overtake the other camels
-this camel lived during the caliphate of Abu Bakr, Umar and Uthman
-Uthman put it in the bait al Mal of the Muslims
-the camel participated in many other battles also
Narrated By Jabir bin 'Abdullah: I was accompanying the Prophet on a journey and was riding a slow camel that was lagging behind the others. The Prophet passed by me and asked, "Who is this?" I replied, "Jabir bin 'Abdullah." He asked, "What is the matter, (why are you late)?" I replied, "I am riding a slow camel." He asked, "Do you have a stick?" I replied in the affirmative. He said, "Give it to me." When I gave it to him, he beat the camel and rebuked it. Then that camel surpassed the others thenceforth. The Prophet said, "Sell it to me." I replied, "It is (a gift) for you, O Allah's Apostle." He said, "Sell it to me. I have bought it for four Dinars (gold pieces) and you can keep on riding it till Medina." When we approached Medina, I started going (towards my house). The Prophet said, "Where are you going?" I Sad, "I have married a widow." He said, "Why have you not married a virgin to fondle with each other?" I said, "My father died and left daughters, so I decided to marry a widow (an experienced woman) (to look after them)." He said, "Well done." When we reached Medina, Allah's Apostle said, "O Bilal, pay him (the price of the camel) and give him extra money." Bilal gave me four Dinars and one Qirat extra. (A sub-narrator said): Jabir added, "The extra Qirat of Allah's Apostle never parted from me." The Qirat was always in Jabir bin 'Abdullah's purse. [Sahih Bukhari, Vol 3, Book 38, Hadith #504]
-the point is When the camel became young, the prophet asked to buy the camel
-Jabir said he would sell it with a condition
-so you can put a condition on the sale
-the prophet told Jabir, Keep the money and keep the camel
-the prophet was so kind to his sahabah
SHARH OF HADITH:
The prayers are compulsory and they are 5
"Do you think that if I perform the obligatory prayers, fast in Ramadhan, treat as lawful that which is halal, and treat as forbidden that which is haram, and do not increase upon that [in voluntary good deeds], then I shall enter Paradise?" He (SAW) replied, "Yes." It was related by Muslim.
Narrated Talha bin 'Ubaidullah: A man came to the Messenger of Allah (SAW) asking him about Islam, the Messenger of Allah (SAW) said, "You have to offer five compulsory prayers in a day and a night (24 hours)." The man asked, "Is there any more compulsory prayers for me?" The prophet replied, "No, unless you like to offer Nawafil (i.e. optional prayers)." The Messenger of Allah (SAW) then added, "You have to observe fasts during the month of Ramadan." The man asked, "Am I to fast any other days?' The prophet replied, "No, unless you wish to observe the optional fast voluntarily." Then the Messenger of Allah (SAW) told him about the compulsory Zakat. The man asked, "Do I have to give anything besides?" The prophet replied, "No, unless you wish to give in charity voluntarily." So, the man departed saying, "By Allah I will neither do more nor less than that." The Messenger of Allah (SAW) said, "If he has said the truth he will be successful." [al-Bukhari (46) and Muslim (11)]
-the above hadith is telling you
-there are different levels of paradise because
-we have different levels of emaan in dunya
Ahmad ibn Hanbal said the man who doesn’t pray witr is wicked
-and his testimony should not be taken
Some people only pray the fard, not nawaafil, tahajjud, witr etc.
-hence there are different levels of Muslims
-and our emaan is not the same
-some fast in the month of Ramadan and fast the six days of Shawwal
-some people make hajj but not make umrah
-some people pay zakah and sadaqa (extra)
-the Nawaafil are superogatory actions (optional)
The fard salah:
-fajr, dhur, asr, maghrib, isha
-What about Eid?
-Some scholars said Eid is Sunnah Mu’akadah
Shaikh-ul-Islaam Ibn Taymeeyah said:"...and consequently we have deemed as being the strongest opinion that the 'Eid ul-Fitr prayer is obligatory upon all individuals. Like the opinion of Aboo Haneefah Refer to Hashiyah ibn 'Aabideen (2/166) and that which comes after it.
-Abu Hanifa said Eid is Waajib and
-Ibn Taymiyya also said Eid is Waajib (agrees with Abu Hanifa)
Umm ‘Atiyyah (RA) narrated: 'The Messenger of Allah (SAW) commanded us to bring them (women) out on (Eid) al-Fitr and (Eid) al-Adha, and to bring out adolescent girls, menstruating women and virgins, but the menstruating women were to stay away from the prayer, but were to witness goodness and the gathering of the Muslims. I said: “O Messenger of Allah, what if one of us does not have a jilbab?” He said: “Let her sister lend her a jilbab.”' [al-Bukhari (324) and Muslim (890)]
-Even menstruating girls were told to go out for Eid
Iyas ibn Abi Ramlah ash-Shami said: 'I witnessed Mu'awiyah ibn Abu Sufyan asking Zayd ibn Arqam: “Have you witnessed along with the Messenger of Allah (SAW) the Friday and 'Eid prayers coinciding on the same day?” He said: “Yes.” He asked: “What did he do?” He replied: 'He offered the 'Eid prayer, then granted concession to offer the Friday prayer, and said: “He amongst you who desires to pray them, pray.” [Sunan Abu Dawud (1/281) No. 1070, Sunan al-Darime (1/459) No. 1612, Sunan Ibn Majah (2/342) No. 1310, Sunan al-Nasa'i (3/194) No. 1591, Musnad Ahmad (4/372) No. 19337, Mustadrak al-Haakim (1/425) No. 1063, Tarikh al-Kabir al-Bukhari (pg. 704) No. 326]
If Eid is on Jumuah, the Eid cancels the jumuah
Ata' said: 'The Friday and the 'Eid prayers coincided on the same day during the time of Ibn az-Zubayr, He said: Two 'Eids coincided on the same day and so they were both joined together by making them one. He prayed on the day of Jumu'ah two raka'hs in the morning and he did not add to them until he prayed Asr Prayer.' [Sunan Abu Dawud (1/281) No. 1072 and Musannaf Abdur Razzaq (3/303) No. 5725]
Ata' ibn Abu Rabah said: 'Ibn az-Zubayr led us in the 'Eid prayer on Friday early in the morning. When we went to offer the Friday prayer, he did not come out to us. So we prayed ourselves alone. At that time Ibn Abbas was present in at-Ta'if. When he came to us, we mentioned this (incident) to him. He said: “He followed the sunnah.” [Sunan Abu Dawud (1/281) No. 1071 and Sunan al-Nasa'i (3/194) No. 1592]
-the Sunnah cannot cancel out the waajib
In some masjid in some countries they pray Eid at 8am in the morning
-then Jumuah salah at 1pm in the afternoon
-do not criticise these Muslims
-when they do some things they are allowed to do
-both madhab are acceptable
-don't be rigid in regards to madhab
What about witr?
-is witr waajib?
Hanafis say it is waajib and you have to make it up (if missed)
-the correct opinion is Witr is Sunnah mu’akadah.
-the two Sunnah before fajr is also Sunnah Mu’akadah.
-the prophet didn't leave the two Sunnah before fajr even when travelling
Salat al Janazah is fard kifaaya
-if a man should die and 10 Muslims buried him
-the community will not be blamed
-Fard al ayn means individual duty
-Fard Kifaaya means a collective duty
-a few do it on behalf of the community
THE FIVE COMPULSORY PRAYERS AND THEIR SUNANS
1. FAJR: Two Sunnah before it and no Sunnah after it
-if you come to the masjid late and miss the Sunnah for fajr
-you are allowed to pray it after you have prayed the fard
2. DHUR: Four Sunnah before it and two Sunnah after it
-there is no such thing called four rak’ah Sunnah
-you pray four rakat: split into two. (two and two)
-the hadith says to split the four rak’ah Sunnah prayers
Abu Qatadah (RA) reported: The Messenger of Allah (SAW) said, "When anyone of you enters the mosque, he should perform two Rak'ah (of voluntary prayer) before sitting." [al-Bukhari (444) and Muslim (714)]
“The day and night prayers are to be prayed two units at a time” [Musnad Ahmad]
3. ASR: Four Sunnah before the fard
-no Sunnah after asr
- Shaikh in Philippines saw a sister pray two Sunnah after asr;
-she said she saw a hadith in Bukhari
-Shaikh explained this was only for the prophet (saw)
Qurtubi was one of the greatest scholars
-he wrote a book called At-Tadkirah
-it is a masterpiece
-but it contains a fabricated hadith:
- (the prophet was devastated that his parents died as kuffaar)
The four Sunnah before asr are Sunnah ghair mu’akadah
-if you leave it off you should not feel guilty about it
-there is no Sunnah after asr: it’s a bid’ah
4. MAGHRIB: Two Sunnah after fard
-the Hanafis don't allow any Sunnah before Maghrib
-but the Hanbalis allow it
5. ESHA: Four Sunnah before and two Sunnah after the fard
Zayd ibn Thabit reported that the Prophet (SAW), said, "O people, pray in your houses. The best prayer is a man's prayer in his house - except for the obligatory prayer." [al-Bukhari (698) and Muslim (781)]
Jabir reported Allah's Messenger (SAW) as saying: When any one of you observes prayer in the mosque he should reserve a part of his prayer for his house, for Allah would make the prayer as a means of betterment in his house. [Sahih Muslim, Book 4, Hadith #1705]
Eid Salah: There is no Sunnah before or after the Eid Salah
-there is no adhan or iqamah for Eid.
- Sunnah, adhan or iqamah for Eid is bid’ah
To fast Ramadan is Fard Al Ayn
-unless you are a child, an old person or terminally ill
-those who are travelling make it up
-menstruating women must make up the fasts missed
THE FIVE CATEGORIES OF HUMAN ACTIONS
1. FARDH: Mandatory, obligatory.
-e.g. to pray five times a day, or fast in Ramadan
-there are 2 types of fard:
-fard al ayn: Individual duty, everyone must do it himself
-Fard al kifaaya: A collective duty, a few do it on behalf of the community
The one who leaves off fard al ayn
-will be punished with the hell-fire on the day of judgement
-the person who fails to fast in Ramadan
-even though he or she was healthy or strong, will be punished with hell
2. THE SUNNAH:
-Sunnah means Recommended
-Two types of Sunnah:
-Sunnah Mu’akadah: Strongly emphasized Sunnah
-Sunnah Ghair Mu’akadah: Not strongly emphasized Sunnah
-e.g. to enter masjid with right foot, and to enter toilet with left foot
It is fard to eat with the right hand; you have no choice in the matter
-e.g. of Sunnah ghair mu’akadah is:
-the four rak’ah before Asr prayer
-the two Sunnah before Maghrib: when you are in Hanafi masjid you, should leave it off
-in order to avert any fitna
A person who leaves off a Sunnah will not be dumped into the hell-fire
-but he should be rebuked for leaving off the Sunnah
-your fard salah will not be perfect
Praying Sunnah is a sign that you love the prophet (saw)
-therefore the person who leaves off the Sunnah should be rebuked
3. HALAL: LAWFUL, PERMISSIBLE
-it means it is up to you to do it or not
-your action is hanging in the balance; you can do the action or leave it off
-you will not be rebuked for leaving it off
-e.g. it is halal to marry your first cousin but the prophet didn't encourage this
-marrying a Christian girl is halal, but the prophet didn't encourage it
It is easy for a Christian to revert, because they don't have to give up Jesus.
-they just believe in him in the right way.
Umar Ibn Al Khattab allowed marrying Christian girls only
-when there are no Muslim girls available to marry
4. MAKHROOH: DISLIKED
-A person will not be dumped into the hell-fire for doing makrooh
-but he should be rebuked from doing it because it’s a stain on his character
-e.g. to 'gatecrash': turn up at a Walimah (wedding party) without an invitation.
-laying on your stomach, delaying Maghrib till the stars appear
-praying with eyes closed, cracking fingers in masjid
5. HARAM: SINFUL (FORBIDDEN, PROHIBITED)
-e.g. Fornication, adultery, eating pork, gambling, drinking alcohol
-backbiting and gossiping
It is reported from Hudhaifa that news reached him (the Holy Prophet) that a certain man carried tales. Upon this Hudhaifa remarked: I heard Allah's Messenger (SAW) saying: "The tale-bearer shall not enter Paradise." [al-Bukhari (6056) and Muslim (189)
There two types of haram: major and minor
-if the punishment is specified it is MAJOR Haram
-e.g. slandering a believing woman: punishment is eighty lashes
It was narrated from Abu Bardah al-Ansari that he heard the Messenger of Allah (SAW) say: "No one should be given more than ten lashes except in the case of one of the hadd punishments of Allah.” [al-Bukhari (6850) and Muslim (1708)]
-no punishment specified: MINOR HARAM
-e.g. men shaking hands of women
NO HARAM CAN EJECT THE PERSON OUTSIDE THE FOLD OF ISLAM UNLESS IT IS MAJOR KUFR
-Adultery is major haram but it is not major kufr
-only the Khawarij say he is a kaafir
-drinking alcohol is a major haram, but not major kufr.
-on judgement day, the drinker and adulterer are under the Will of Allah
-if Allah Wills He will punish them
-If Allah wants He will forgive them
Verily, Allāh forgives not that partners should be set up with him in worship, but He forgives except that (anything else) to whom He pleases, and whoever sets up partners with Allāh in worship, he has indeed invented a tremendous sin. (An-Nisa 4:48)
EXAMPLES OF HARAM THAT ARE MAJOR KUFR
1. TO DABBLE IN BLACK MAGIC
- All the scholars say this man is a kaafir
Jundub (RA) reported that the Messenger of Allah (SAW) said: “The hadd (prescribed punishment) for the practitioner of magic is a blow with the sword (i.e., execution)" [Sunan Tirmidhi (4/60) No. 1460, Sunan al-Daraqutni (4/120) No. 3204, Mustadrak al-Haakim (4/401) No. 8073, al-Sunan al-Kabir al-Bayhaqi (8/234) No. 16500, al-Mu'jam al-Kabir al-Tabarani (2/161) No. 1665]
2. TO INSULT ALLAH, HIS RASOOL OR THE QURAN.
Hussain ibn Ali related from his father Ali Ibn Abi Talib that the Messenger of Allah (SAW) said: "Whoever curses a Prophet, kill him. Whoever curses my Companions, beat him." [al-Mu’jam al-Awsat al-Tabarani (5/35) No. 4602]
3. TO REJECT WHAT IS KNOWN OF ISLAM BY NECESSITY.
Shaykh al-Islam Ibn Taymiyyah (d. 728H): “Whenever a person makes halal what is haraam by consensus or makes haraam what is halal by consensus or replaces the Sharee’ah that is agreed upon by consensus, then he is a Kaffir by the agreement of the scholars of Fiqh.” – “Al-Fataawa”, Vol. 3/267
-It is known of Islam by necessity that pork is haram; if you make it halal you are a kaafir.
And whoever contradicts and opposes the Messenger (Muhammad SAW) after the right path has been shown clearly to him, and follows other than the believers' way. We shall keep him in the path he has chosen, and burn him in Hell - what an evil destination. (An-Nisa 4:115)
-when you reject what is known by necessity, you reject the ijmaa of the Ummah.
4. TO SPY FOR THE KUFFAAR AGAINST THE MUJAHIDEEN
-they give their walaa (allegiance) to the kuffaar
Sheikh Muhammad ibn Abdul Wahab, may Allah have mercy on him, gathered ten actions that negate one's Islam (Nawaqid ul-'Ashr), the eighth one of which states: "Assisting the disbelievers (against the believers) (Mudhaharatul Mushrikeen) and supporting them against the believers (is from the actions that negates of one's faith). The Proof being the statement of Allah, "And if any amongst you takes them as Auliya', then surely he is one of them. Verily, Allah guides not those people who are the Zalimun (polytheists and wrong-doers and unjust). (The Quran 5:51)."
THE PRINCIPLES OF HALAL AND HARAM
1. ONLY ALLAH HAS THE AUTHORITY TO MAKE THINGS HALAL OR HARAM
..., and He makes none to share in His Decision and His Rule." (Al-Kahf 18:26)
2. ALLAH HAS GIVEN THE RASOOL THE PERMISSION TO MAKE THINGS HALAL AND HARAM
-by way of hadith
-the hadith is wahyi (revelation)
Nor does he speak of (his own) desire. (An-Najm 53:3)
It is only an Inspiration that is inspired. (An-Najm 53:4)
...And whatsoever the Messenger (Muhammad SAW) gives you, take it, and whatsoever he forbids you, abstain (from it), and fear Allāh. Verily, Allāh is Severe in punishment. (Al-Hashr 59:7)
Jabir ibn Abdullah (RA) narrated the Messenger of Allah (SAW) said in the Jumu’ah khutbah: "...To proceed. The best of the speech is embodied in the Book of Allah, and the best of the guidance is the guidance given by Muhammad. And the most evil affairs are their innovations; and every innovation is error..." [Sahih Muslim (2/592) No. 867]
3. TO MAKE WHAT IS HARAM HALAL (OR HALAL HARAM) IS AN ACT OF KUFR AND APOSTASY
Shaykh al-Islam Ibn Taymiyyah (d. 728H): “Whenever a person makes halal what is haraam by consensus or makes haraam what is halal by consensus or replaces the Sharee’ah that is agreed upon by consensus, then he is a Kaffir by the agreement of the scholars of Fiqh.” – “Al-Fataawa”, Vol. 3/267
4. TO FOLLOW A WICKED SCHOLAR MAKES YOU A KAAFIR AND YOU WONT BE LET OFF ON JUDGEMENT DAY
-Allah said: 2:166
When those who were followed, disown (declare themselves innocent of) those who followed (them), and they see the torment, then all their relations will be cut off from them. (Al-Baqarah 2:166)
They (Jews and Christians) took their rabbis and their monks to be their lords besides Allāh (by obeying them in things which they made lawful or unlawful according to their own desires without being ordered by Allāh), and (they also took as their Lord) Messiah, son of Maryam (Mary), while they (Jews and Christians) were commanded [in the Taurāt (Torah) and the Injeel (Gospel)) to worship none but One Ilāh (God - Allāh) Lā ilāha illa Huwa (none has the right to be worshipped but He). Praise and glory be to Him, (far above is He) from having the partners they associate (with Him)." (At-Tawbah 9:31)
Imam Ahmad, At-Tirmidhi and Ibn Jarir At-Tabari recorded a Hadith via several chains of narration, from 'Adi bin Hatim (RA), who became a Christian during the time of Jahiliyya. When the call of the Messenger of Allah reached his area, 'Adi ran away to Ash-Sham, and his sister and several of his people were captured. The Messenger of Allah freed his sister and gave her gifts. So she went to her brother and encouraged him to become Muslim and to go to the Messenger of Allah. 'Adi, who was one of the chiefs of his people (the tribe of Tai') and whose father, Hatim At-Ta’i, was known for his generosity, went to Al-Madinah. When the people announced his arrival, 'Adi went to the Messenger of Allah wearing a silver cross around his neck. The Messenger of Allah recited this Ayah; They took their rabbis and their monks to be their lords besides Allah. 'Adi commented, "I said, ‘They did not worship them.’" The Prophet said, ((Yes they did. They (rabbis and monks) prohibited the allowed for them (Christians and Jews) and allowed the prohibited, and they obeyed them. This is how they worshiped them.)) … They took their rabbis and their monks to be their lords besides Allah… that the Christians and Jews obeyed their monks and rabbis in whatever they allowed or prohibited for them…" (Tafsir Ibn Kathir (Eng Abridged), First Edition: May 2000], Volume 4, pp. 409-410)
5. ANYTHING THAT LEADS TO HARAM IS HARAM
-you are not allowed to be alone with a girl
Narrated Umar ibn al-Khattab: The Prophet said, "...Whenever a man is alone with a woman the Devil makes a third..." [Musnad Ahmad (1/26) No. 177, Sunan Tirmidhi (4/465) No. 2165, Mustadrak al-Haakim (1/197) No. 387, Sahih Ibn Hibban (12/399) No. 5586, Nasa'i in 'Sunan al-Kubra' (5/387) No. 9219]
-Allah did not say don't commit zina
-Allah said don't come near to zina
And come not near to the unlawful sexual intercourse. Verily, it is a Fāhishah [i.e. anything that transgresses its limits (a great sin)], and an evil way (that leads one to Hell unless Allāh forgives him). (Al-Isra 17:32)
6. WHAT IS HARAM FOR ONE IS HARAM FOR ALL
-after the rasul (saw) explained to the man, no one hated zina more than this man
Abu Umamah (RA) saying that a young man came to the Prophet (SAW) and said, "O Messenger of Allah! Give me permission to commit Zina (unlawful sex).'' The people surrounded him and rebuked him, saying, "Stop! Stop!'' But the Prophet said, "(Come close)". The young man came to him, and he said, "(Sit down)", so he sat down. The Prophet said, "(Would you like it (unlawful sex) for your mother?)" He said, "No, by Allah, may I be ransomed for you.'' The Prophet said, "(Neither do the people like it for their mothers!)" The Prophet said, "(Would you like it for your daughter?)" He said, "No, by Allah, may I be ransomed for you.'' The Prophet said, "(Neither do the people like it for their daughters!)" The Prophet said, "(Would you like it for your sister?)" He said, "No, by Allah, may I be ransomed for you.'' The Prophet said, "(Neither do the people like it for their sisters!)" The Prophet said, "(Would you like it for your paternal aunt?)" He said, "No, by Allah, O Allah's Messenger! May I be ransomed for you.'' The Prophet said, "(Neither do the people like it for their paternal aunts!)" The Prophet said, "(Would you like it for your maternal aunt?)" He said, "No, by Allah, O Allah's Messenger! May I be ransomed for you.'' The Prophet said, "(Neither do the people like it for their maternal aunts!)" Then the Prophet put his hand on him and said, "(O Allah, forgive his sin, purify his heart and guard his chastity.)" After that the young man never paid attention to anything of that nature. [Musnad Ahmad, (Vol. 5, pg. 256) No. 22265]
7. ONLY THAT WHICH IS HARMFUL TO US WAS MADE HARAM BY ALLAH
8. TRICKERY TO BYPASS HARAM IS HARAM
-The Jews set the fish net to catch the fish on Saturday
-the women were told to wear hijab, instead they wore wigs!
9. WHAT IS HARAM IN LARGE QUANTITY IS HARAM IN SMALL QUANTITY
-a man will say: "I will know when to stop drinking ".
10. CHANGING THE NAME OF THE MUNKAR DOESN'T MAKE IT HALAL
-A prostitute calls her zina "business"
-the bastard child they call "the love child"
-we don't care what you want to call the munkar: it is still haram.
-The shaytan called the haram tree: "the tree of eternal life"
-they call the homosexual the word "gay" meaning happy.
11. EVERYTHING IS HALAL UNTIL PROVEN HARAM
Allāh wishes to lighten (the burden) for you; and man was created weak (cannot be patient to leave sexual intercourse with woman). (An-Nisa 4:28)
12. GOOD INTENTION DOESN'T JUSTIFY DOING HARAM
13. THE HARAM BECOMES HALAL OUT OF NECESSITY
-you are allowed to eat pork to save your life
Say (O Muhammad SAW): "I find not in that which has been inspired to me anything forbidden to be eaten by one who wishes to eat it, unless it be Maytatah (a dead animal) or blood poured forth (by slaughtering or the like), or the flesh of swine (pork, etc.) for that surely is impure, or impious (unlawful) meat (of an animal) which is slaughtered as a sacrifice for others than Allāh (or has been slaughtered for idols, etc., or on which Allāh's Name has not been mentioned while slaughtering). But whosoever is forced by necessity without wilful disobedience, nor transgressing due limits, (for him) certainly, your Lord is Oft¬Forgiving, Most Merciful." (Al-An'am 6:145)
“If one is in dire need and found a dead body of an animal, a swine, or of human, he might eat the dead animal because it as “Halal” (lawful or permissible), but not the body of a swine or a human”. There is a light prevention and a strong prevention, and these are the rules, such as one hates to have sexual relation with his sister, but can have a sexual relation with a foreigner because it is lawful for him. This is the condition for theses rules. Eating the flesh of a human is not allowed. Yet the scholars Ahmad and Dawoud protested by saying that prophet Mohammad said, “Breaking the bones of a dead body is like breaking the bones of a live body. Al-Shafie said, “One may eat the flesh of a human body. It is not allowed to kill a Muslim nor a free non-Muslim under Muslim rule (because he is useful for the society), nor a prisoner because he belongs to other Muslims. But you may kill an enemy fighter or an adulterer and eat his body”. Dawoud slandered Al-Mozny by addressing Al-Mozny saying, “You allowed eating the flesh of the prophets”. Ibn Sharie responded also to Al-Mozny by saying, “You allowed killing the prophets and did not allow eating the flesh of the infidels”. Ibn Al-Araby said, “The proper thing for me is not to eat human flesh unless the person makes sure that this act saves him from starving to death and Allah knows best”. [Tafseer al-Qurtubi (2/229)]
-If you are choking and the only thing you find is a bottle of wine: you can drink the wine.
-if your mother needs an emergency operation
-you can borrow a loan from the bank with riba.
14. DOUBTFUL MATTERS SHOULD BE AVOIDED AND SHOULD NOT BE PRONOUNCED HALAL
And most of them follow nothing but conjecture. Certainly, conjecture can be of no avail against the truth. Surely, Allāh is All-Aware of what they do. (Yunus 10:36)
-A doubt will never take the place of the truth.
-A doubt is not hujjah.
An-Nu'man ibn Bashir said, "I heard the Messenger of Allah (SAW), say, 'The halal is clear and the haram is clear. But between the two there are doubtful things about which most people have no knowledge. Whoever exercises caution with regard to what is doubtful, shows prudence in respect of his deen and his honour. Whoever gets involved in the doubtful things is like a herdsman who grazes his animals near a private preserve (hima). He is bound to enter it. Every king has a private preserve and the private preserve of Allah on His earth are the things that He has made forbidden. There is a lump of flesh in the body, the nature of which is that when it is sound, the entire body is sound, and when it is corrupt, the entire body is corrupt - it is the heart.'" [al-Bukhari (52) and Muslim (1599)]
15. THE EXCUSE OF IGNORANCE IS GIVEN TO A PERSON WHO IS JAAHIL (IGNORANT) ABOUT HALAL AND HARAM.
- When Umar was caliph a woman slept with her slave.
-he didn't punish her because he realised she was jaahil
On the authority of Qataada who said: “A woman slept with her male servant and cited an ayah of the Holy Qur'an as her evidence for her action. ‘…or the (female) slaves whom their right hands possess…’ (An-Nur 24:31). This woman was brought to Umar ibn al-Khattab (RA) by a group of Sahabas who complained to Umar that she misinterpreted a verse from the Holy Qur’an and slept with her male servant. Umar commanded that the male servant should be sent away for a year and he was beheaded. He then said to the woman you are now haram for all Muslims.” [Tafseer al-Tabari (9/586) No. 11277]
THE EXCUSE OF IGNORANCE IS NOT GIVEN TO A PERSON WHO COMMITS THE SHIRK OF IBAADAH (WORSHIP)
-Allah did not let the father of the prophet (saw) off.
Narrated from Anas (RA) that a man said: “O Messenger of Allah, where is my father?” He said: “In Hell.” When he turned away he called him back and said: “My father and your father are in Hell.” [Sahih Muslim (Vol. 1, pg. 191) No. 203]
-the murjia claim that the grave worshipper can still be a Muslim
Yahya related to me from Malik from Zayd ibn Aslam from Ata ibn Yasar that the Messenger of Allah (SAW) said, "O Allah! Do not make my grave an idol that is worshipped. The anger on those who took the graves of their Prophets as places of prostration was terrible." [Muwatta Malik (1/223) No. 570, Musannaf Abdur Razzaq (1/406) No. 1587, Musnad Ahmad (2/246) No. 7352]
Assalamu alaikum shaikh some people have what is called methanol poisoning and the treatment for it is ethanol which is alcohol. Are you allowed to give these patients alcohol to correct the poisoning?
-prophet said alcohol is not a cure; it is a disease
-another cure should be found
-if a trustworthy Muslim doctor says no alternative you can take it
Assalamu alaikum sheikh, does missing multiple jumuah make you a kafir?
-people living in darul harb miss multiple jumuah because of time
-sometimes the masjid is an hour away
-it is not an Islamic state where multiple masjids are facilitated
-Abu Hanifa says jumuah is not compulsory if you live in darul harb
Assalamu alaikum, are surahs to be recited in Sunnah rak’ah, and when and how do we make dua?
-you are supposed to recite surahs in all prayers
-fatiha is fard
-if you leave out a surah after fatiha it is not a sin
-making dua after every single salah is bid’ah
-if you do it every salah you are misleading the jamaa’a
-qunoot is acceptable
Sheikh, if a Muslim was once on drugs living in darul harb but made sincere taubah and tried to leave darul harb but cannot, will he be forgiven?
-why can't he leave darul harb?
-Umar Bakri escaped darul harb
-the kuffar were embarrassed when they realised he had escaped
.... And whosoever fears Allāh and keeps his duty to Him, He will make a way for him to get out (from every difficulty). (At-Talaq 65:2)
And He will provide him from (sources) he never could imagine. And whosoever puts his trust in Allāh, then He will suffice him. Verily, Allāh will accomplish his purpose. Indeed Allāh has set a measure for all things. (At-Talaq 65:3)
-if you stay in darul harb because you couldn't escape you did not do anything wrong
Verily! As for those whom the angels take (in death) while they are wronging themselves (as they stayed among the disbelievers even though emigration was obligatory for them), they (angels) say (to them): "In what (condition) were you?" They reply: "We were weak and oppressed on earth." They (angels) say: "Was not the earth of Allāh spacious enough for you to emigrate therein?" Such men will find their abode in Hell - What an evil destination! (An-Nisa 4:97)
Except the weak ones among men, women and children who cannot devise a plan, nor are they able to direct their way. (An-Nisa 4:98)
-it's those who stay in darul harb and they have the ability to leave who are sinning
-Babar Ahmed is being destroyed because he lives behind enemy lines
It was narrated from Samurah that the Prophet (SAW) said: “Do not live among the mushrikeen and do not mix with them, for whoever lives among them or mixes with them is not one of us.” [al-Sunan al-Kubra al-Bayhaqi (9/240) No. 18420 and Mustadrak al-Haakim (2/154) No. 2627. adh-Dhahabi graded this on the conditions of Bukhari and Muslim]
On the authority of Jarir bin 'Abdullah that the Messenger of Allah (SAW) sent a military expedition to Khath'am. So some people (living there) sought safety by prostrating, but they were met quickly and killed. News of this reached the Prophet (SAW) upon which he commanded that they be given half of the 'Aql (blood money). And he said: "I am free from every Muslim that lives among the idolaters." They said: "O Messenger of Allah: How is that?" He said: "They should not see each other's campfires." [Sunan Tirmidhi (4/155) No. 1604 and Sunan Abu Dawud (3/45) No. 2645]
The salaf ulama considered tahakum at the taghoot court shirk and worship like in the time of the tartar on the consensus of the Muslims. Today you hear different ulama saying it is permissible in some cases for example when there is no Shari’ah court. But they give no sound dalil (evidence) from Quran or Hadith.
-tahakum should not be condemned totally
-if a Muslim’s car got stolen and he has to go and identify it
-he has not done wrong; his property is sacred
-he did not do tahakum
-he can be compensated for injury like whiplash
While 'Allama al-Shinqiti-May Allah be merciful with him-has said: To commit shirk with Allah in judging is of the same meaning as to commit shirk in His worship, there is no difference between the two in any manner. There is no difference in any sense between he who follows a system (nizam) other than Allah's system or law other than Allah's law (sharia) and he who worships an idol or prostrates to a false god. They are the same and both are polytheists [associating others] with Allah. [Adwa' al-Bayan, (7/162)]
-shirk is when he prefers non-Shari’ah court
-he becomes a kaffir for this
-like bowing down to idols
