PART 2
MAY 11 2014 - 11 RAJAB 1435 HIJRI

BY SHAIKH ABDULLAH AL FAISAL

QUESTION AND ANSWER:

QUESTION 1:

ASSALAMU ALAIKUM SHAIKH, THE SHIA HAVE ALWAYS UNITED WITH WITH KUFFAR AGAINST THE MUSLIMS, E.G. THE CRUSADERS, THE MONGOLS AND WHAT WE SEE TODAY. IS IT WISE FOR THE MUSLIMS TO SEEK HELP FROM THE KUFFAR, SINCE THEIR INTENTIONS DON'T HAVE ANY INTEREST IN THE WELL BEING OF THE MUSLIMS. ANDALUS FELL BECAUSE THE MUSLIM WERE FIGHTING AMONGST THEMSELVES AND THEY MADE TREATIES WITH THE KUFFAR WHO BETRAYED THEM, ALSO A SIMILAR SITUATION WITH THE CRUSADERS. IT TOOK HUNDREDS OF YEARS FOR THE MUSLIMS TO UNITE AND REMOVE THE CRUSADERS. WHAT IS THE WAY FORWARD IN OUR TIME? DEALING WITH THE SHIA, UNITING THE UMMAH OR JIHAD?

ANSWER 1

You are allowed to take weapons from America and even Jews in Israel to fight the shia in Iran and the shia in Syria as they are the worse of people.

QUESTION 2:

SHAIKH I HEARD THAT WAS FABRICATED BY THE SHIA - THE MURDERER OF UTHMAN BEING MUHAMMAD IBN ABI BAKR AND THAT THEY CAUGHT HIM AND STUFFED HIM INTO A DONKEY AND BURNT HIS BODY?

ANSWER 2:

This question requires further research

The shia say that Aisha (RAA) married Talha after the death of the prophet (sallallahu alayhi wa sallam). Talha did love Aisha, but the prophet (sallallahu alayhi wa sallam) did not tell him off.

And it is not (right) for you that you should annoy Allah's Messenger, nor that you should ever marry his wives after him (his death). Verily! With Allah that shall be an enormity.

(Al-Ahzab 33:53)

The above ayah came down for Talha.

The shia say in that a Muslim woman cannot travel without a mahram. So Aisha had a mahram on her journey to go fight Ali, and the shia say she was with Talha.

The shia say Aisha (RAA) married Talha and consumated the marriage.

QUESTION 3

ASSALAM WA ALAIKUM... ABU HANIFA SAYS THAT WE CAN SELL ALCOHOL IN DARUL HARB TO KUFAAR & THERE'S A HADITH REGARDING 10 THAT ALLAH CURSES... WHICH OPINION'S MOST ACCURATE?

ANSWER 4:

This fatwa of Abu Hanifa is in the book called al Mughnee by Ibn Qudama.

Anas ibn Maalik reported that Allah’s Messenger (SAW) cursed ten man concerning wine. 1. One who extracts it. 2. One who gets it extracted. 3. One who drinks it. 4. One who delivers it. 5. One to whom it is brought. 6. One who serves it. 7. One who sells it. 8. One who receives its price. 9. One who buys it. 10. One for whom it is bought.

[Sunan Tirmidhi (3/581-582) No. 1295 and Sunan Ibn Majah (4/468) No. 3381]

Because when a kaafir dies, his soul will abide in hellfire forever, so Abu Hanifa's fatwa is correct. The hadith of the ten people that Allah (SWT) curses, can only be applied in a Muslim country.
the above hadith can only be applied in the Islamic state.

Abu Hanifa said, you should employ a kaafir to sell the alcohol. If the Taliban sold opium to the kuffar, it is allowed as they are following the hanafi madhab.

Imam Azam Abu Hanifa and Imam Muhammad states that it is ok for a Muslim living in a non-Muslim country to get interest from non-Muslims, to sell drink and pork to non-Muslims and even to gamble with them if it is certain to win; since these acts are legal for the non-Muslims, and Muslims’ benefiting from these acts can be considered as some kind of ganimah (treasure won in war).

The Muslims in the UK with off licenses selling to kuffar are not doing anything wrong as they are following their madhab.

QUESTION 4:

SHAIKH, HOW CAN A FATAWA SUPERCEDE THE HADITH OF THE PROPHET?

A fatwa can supersede the hadith if it is a necessity, if it is a life and death situation.

E.g. growing the beard is a fardh, and if the kuffar are killing Muslims, you can shave your beard and leave the country with a Christian name.
