06 September 2014 / 12 Dhul Qa’dah 1435 (Evening)

NOTES typed by AT19

Edited by kawthar4218
-There has always been from the beginning the validity of the Khilaafa
-The shia originally were not rafida
-The shia put a condition that the khalifa must be from ahlu bayt
-Based on the small dispute that the khilaafa must be from the family of the prophet saws
has not validity
-We cannot put conditions on something that doesnt exist in Quran and Sunnah
-Making Umar or Ali better is innovation

On the authority of Aisha (RA): The Messenger of Allah (SAW) said: "He who innovates something in this matter of ours that is not of it will have it rejected." [al-Bukhari (2697) and Muslim (171]

-This grudge was developed by the shia
-This made the shia rafida
-See how dangerous this idea can become complete misguidance?
-For years we have been talking about khilaafa
-Since before 1924

-The Jews were talking about the new Nabi will come
-When he came, they complained "why he is not from our tribe"
- Safiyya, the Jewish wife, accepted the prophet (saw) and accepted Islam
-His worst enemy accepted all the signs that the Nabi had arrived

Saffiyah says, "I was my father's and my uncle's favorite child. When the Messenger of Allah came to Madinah and stayed at Quba, my parents went to him at night and when they looked disconcerted and worn out. I received them cheerfully but to my surprise no one of them turned to me. They were so grieved that they did not feel my presence. I heard my uncle, Abu Yasir, saying to my father, 'Is it really him?' He said, 'Yes, by Allah'. My uncle said: 'Can you recognize him and confirm this?' He said, 'Yes'. My uncle said, 'How do you feel towards him?' He said, 'By Allah I shall be his enemy as long as I live.'" (Ibn Hisham, As-Sirah an-Nabawiyyah, vol. 2, pp. 257-258, Cited in Muhammad Fathi Mus'ad, The Wives of the Prophet Muhammad: Their Strives and Their Lives, p.162)

-Their own nafs, racism and tribalism made them reject the Prophet (saws)
-He met all the signs and conditions of revelations yet they still rejected him
-Peoples own desires, grudges etc make them refute the khilaafa
-Sometimes what they quote are not even true
-They behave like Jews when they reject the khilaafa
-If all the conditions of a marriage are met, the marriage is valid
-All the conditions of the Caliphate are found so it is valid
-We cannot use dodgy conditions to reject the khilaafa
-Why should we obey the taghut and disobey the khilaafa
-The khilaafa is the ruling system in Islam
-A system Allah has created for managing the people
-When the people unite under one system of rule, it becomes a Caliphate

-The rule is for Allah only
-Do not associate partners with Allah (SWT)

"You do not worship besides Him but only names which you have named (forged), you and your fathers, for which Allah has sent down no authority. The command (or the judgement) is for none but Allah. He has commanded that you worship none but Him (i.e. His Monotheism), that is the (true) straight religion, but most men know not. (Yusuf 12:40)

Say: "Allah knows best how long they stayed. With Him is (the knowledge of) the unseen of the heavens and the earth. How clearly He sees, and hears (everything)! They have no Wali (Helper, Disposer of affairs, Protector, etc.) other than Him, and He makes none to share in His Decision and His Rule." (Al-Kahf 18:26)

-Quran and Sunnah is the only law that is implemented
-In KSA they cut the hand of the thief But they allow interest
-So this is not real shariah
O you who believe! Obey Allah and obey the Messenger (Muhammad SAW), and those of you (Muslims) who are in authority. (And) if you differ in anything amongst yourselves, refer it to Allah and His Messenger (SAW), if you believe in Allah and in the Last Day. That is better and more suitable for final determination. (An-Nisa 4:59)

-You only obey those who are in authority if they implement shariah
-You cannot mix shariah with kufr laws
-The shariah has to be pure

-The Showka is the power
Those (hyprocrites) who wait and watch about you; if you gain a victory from Allah, they say: "Were we not with you," but if the disbelievers gain a success, they say (to them) : "Did we not gain mastery over you and did we not protect you from the believers?" Allah will judge between you (all) on the Day of Resurrection. And never will Allah grant to the disbelievers a way (to triumph) over the believers. (An-Nisa 4:141)

Allah has promised those among you who believe, and do righteous good deeds, that He will certainly grant them succession to (the present rulers) in the earth, as He granted it to those before them, and that He will grant them the authority to practise their religion, that which He has chosen for them (i.e. Islam). And He will surely give them in exchange a safe security after their fear (provided) they (believers) worship Me and do not associate anything (in worship) with Me. But whoever disbelieved after this, they are the Fasiqun (rebellious, disobedient to Allah). (An-Nur 24:55)

-Allah promised the believers that, He will give them authority on earth in the above ayah
-There is only one authority - no second law
-Under the oppression of the kuffar, Allah will replace them with security

-Ali said dont fight them until they rebel - so he fought them

Abu Bukhture asked Ali (RA) about people of Jamal. 'Are they Mushrikun?' He replied: “They ran from Shirk.” Then I asked: 'Are they hypocrites?” He replied: “Hypocrites used to mention Allah rarely.” He was asked: 'Then who are they?' Ali (RA) replied: “They are our brothers that rebelled against us.” [Bayhaqi in 'Sunan al-Kubra' (8/173) No. 16490 and Ibn Abi Shaybah in 'al-Musannaf', (7/535) No. 37763]

-Some say you have many Islamic states
-There is only one Khilaafa
-Even if there is an ocean in between
-There cannot be any borders between the Islamic states
-It is haram to have two Caliphs
-Because you have to kill the second Caliph
-Anyone who dies without giving bayah, dies the death of jahiliyyah

...and one who dies without having bound himself by an oath of allegiance (to an Amir) will die the death of one belonging to the days of Jahillyya. [Sahih Muslim, Book 20, Hadith #4562]

-A khilaafa was appointed to be obeyed
-You can't please everybody
-So you have to obey the Khalifa

-The sahabas were going to a city where their was a plague

Abu 'Ubaida bin Al-Jarrah said (to 'Umar), "Are you running away from what Allah had ordained?" 'Umar said, "Would that someone else had said such a thing, O Abu 'Ubaida! Yes, we are running from what Allah had ordained to what Allah has ordained. Don't you agree that if you had camels that went down a valley having two places, one green and the other dry, you would graze them on the green one only if Allah had ordained that, and you would graze them on the dry one only if Allah had ordained that?" At that time 'Abdur-Rahman bin 'Auf, who had been absent because of some job, came and said, "I have some knowledge about this. I have heard Allah's Apostle saying, 'If you hear about it (an outbreak of plague) in a land, do not go to it; but if plague breaks out in a country where you are staying, do not run away from it.'" 'Umar thanked Allah and returned to Medina. [Sahih Bukhari, Vol 7, Book 71, Hadith 625]

-What we learn from this is that the decision of the khalifa is final

It was narrated from Ibn ‘Umar that the Prophet (SAW) said: “Each of you is a shepherd and each of you is responsible for his flock. The ruler is a shepherd and is responsible for his flock; the man is the shepherd of his family members and is responsible for them; the woman is the shepherd of her husband’s house and children and is responsible for them; the slave is the shepherd of his master’s wealth and is responsible for it. Each of you is a shepherd and each of you is responsible for his flock.” [al-Bukhari #853 and Muslim #1829]

-The decision of the Imam is in charge of the flock
-He doesnt order us to do haram

-So they are destroying the shrines of the disbelievers
-People are now testifying how secure it is there now
-since being established by the dawla

-They have free medication
-Free glasses
-Free education
-Free bus service

-With the shariah court

And fight them until there is no more Fitnah (disbelief and polytheism: i.e. worshipping others besides Allah) and the religion (worship) will all be for Allah Alone [in the whole of the world[]]. But if they cease (worshipping others besides Allah), then certainly, Allah is All-Seer of what they do. (Al-Anfal 8:39)

-People don't laugh now, they are crying
-He needs to be male, muslim, trustworthy, free, capable, from qurash, scholar
-He meets all of these qualifications
-He also has to be brave
-Condition of bayah, that those giving the bayah have to be people in control (people of importance)
-Ahlul hal wal aqd = people of importance
"...You will listen to the Amir and carry out his orders; even if your back is flogged and your wealth is snatched, you should listen and obey." [Sahih Muslim, Book 20, Hadith #4554]

-Only the khawarij see the invalidation of the khilafa during the era of Ali
-Only the khawarij rebel against a legitimate khilafa
-Only a few gave bayah to Abu Bakr, yet his khilafa was valid
-because they were ahlul hal wal aqd ie people of importance
-The right of a khilafa to be obeyed, he must be available not in prison

-Mullah Umar did not claim to be a khalifa for all Muslims
-He is only the amir for afghanistan

Imam Al-Nawawi said,"The opinion of the A'immah regarding the Imam who takes authority by force is that it is valid, provided that he implements the Sharī'ah even if he was Fāsiq or Jāhil."[Rawdat al-Talibeen (10/46)]

-The valid conditions of the the Khilafa has been met

Imam Ahmad Ibn Hanbal stated:"Whoever rises against any Imam of the Muslims, where the people have gathered together and consent to the Khilāfah by him even if it was done so by force, anyone that rises against such a person will be committing disobedience and contradict what Muhammad (SAW) taught."[al-Madkhal ila Madhab al-Imam Ahmad ibn Hanbal by Abdul Qadir Badran (pg. 79)]

QUESTION #1: Why are all the Ulema of jihad like Shks. Sulaiman Al Ulwan, Dr Jazouli, Ash-Shinqeeti, Maqdisi, Abu Qatadah, etc rejecting Dowla? Who among the huq scholars are supporting dowlah?

-Sulaiman Al Ulwan didn't comment on the dawla because he is not free to speak
-Because he is in KSA
-Abu Qatadah is not free to speak - he is also in prison
-A shaikh who is not free to speak should not be relied upon for fatwas about the dawla

QUESTION #2: Asalamu Alaikum wa rahmatullahi wa barakatu, the hype and the news going on about Dawla stealing girls between 10-15 years against their will, how much truth is in that? and why is Dawla NOT responding to such claims?

-The success of the dawla speaks for itself
-I have never heard any evidence of the ages of these girls
-The dawla took some slaves from the Yazidis and this is not stealing
-They are part of the booty
-Because they are devil worshipers

QUESTION #3: how can someone still living outside the islamic state, let it be in europe, give baya? does it need to be in a group?

-The bayah by the hand or verbally is usually a few people
-The majority is enough that they obey the khilafa

Al-Nawawi (rh) said: With regard to bay’ah (oath of allegiance): the scholars are agreed that in order for it to be valid it is not essential for all the people or all the decision makers to give their bay’ah. Rather, if bay’ah is given by those scholars and people of virtue and status who are present, that is sufficient. It is not obligatory for each person to come to the leader and put his hand in his and give his oath of allegiance to him.
Rather what is required of each individual is to submit to him and not go against him or rebel against him. [Sharh Sahih Muslim (12/77)]

-You do not have to be in the dawla to give bayah

QUESTION #4: Asalaam Alaikum Ustadh Abu Baraa, Jazakallah Khairen for your dars. Please can you give your veiws as to why hizb ut tahrir have rejected the khilafah and if their founder had a deviant aqeedah? Also, what is the best route to travel to the khilafah if traveling from America or Europe?

-This has less to do with grudges by more about legal issues
-because they said they do not have showkah
-showkah = power
-But the dawla has showkah as we can see
-So HT is wrong
-about the dawla

QUESTION 5: JN they conrolled an area at one point before the khilafa was established where they part of ahl al hal wal aqd and did they have to be consulted

-Part of JN argument is that they do not have full control to implement in Syria
-but we cannot be without a khilafa for more than 3 days, and it's been 90 years of not having one
-so it's haram to delay further
